CoE asks Effective Investigations on MISSING People and slams Impunity, but reveals Delays on Cyprus

*Strasbourg/CoE/Angelo Marcopolo/- CoE's Assembly asked for "Effective Investigations" on MISSING People's cases, in a Resolution adopted Today, while both its President, Mignon, and its Rapporteur, Sheridan, critically pointed at an exceptional Delay in Cyprus, despite which, a T/C Politician nevertheless wanted a "Closure" and dismissed demands for searches in Ankara's Foreign Invasion/Occupation Army's Military Zones, (See Infra), even if a parallel CoE's Resolution, adopted Yesterday, condemned abuses of "Security" pretexts in attempts to Block Access to key Information, Covering-up Serious Crimes as Enforced Disappearances.

+ In a last-minute adopted Amendment, a 2013 CoE's PanEuropean Parliamentary Assembly's Resolution asked to clearly "Recognize""Missing persons' Families'" "Right to an Effective Investigation, and to know the Truth", by ensuring that any "Systematic Denial" of those Rights by any "Authority" is "Punished as a Criminal Offence", while "Perpetrators of Enforced Disappearance are Prosecuted" and "do not benefit from any Amnesty or similar measures that might exempt them from Criminal Responsibility".

- For that purpose, "identification process of Human Remains" must "include" not only "DNA analysis", but also "other Forensic (i.e. in order to obtain and safeguard Evidence for Prosecuting eventual Criminal Offences) and Scientific Methods of Expertise ; while "all professionals involved in Forensic recovery" must "respect the Legal rules /Professional Ethics", and "ownership of the Forensic Expertise, including (that which is) provided by the International Committee of the Red Cross (ICRC) and the International Commission on Missing Persons (ICMP)", should be "ensured".

- Moreover, "Families of Missing persons" must be "placed" "at the Centre of all Actions concerning this issue", as a matter of "1st Priority", and, therefore, they must be "involve(d)" in "the Investigations into the cases", and "contribute significantly to the process of Solving the issue of Missing persons", "provide(d) ... with the necessary Legal, Psychological and Social Assistance", according to CoE's Resolution. - "Solving the problem of missing persons following armed conflicts in Europe is Vital for establishing Reconciliation between Warring factions and ensuring Peace on the European continent", while "there are still more than 20 000 Missing persons following Conflicts" in Europe, as old as "in Cyprus", followed more recently by "the Balkans and the North and South Caucasus".

- According to CoE Assembly's President, Jean-Claude Mignon, it's a paradox but a fact that "the enormous work done (by the IRCC and others) in the Balkans has borne fruit, as nearly 70% of the Missing persons have been found, but (on the contrary) in Cyprus and the ...Caucasus unfortunately the results are more Modest", as he denounced.

Indeed, the Statistics revealed by CoE's Rapporteur, Brittish Socialist MEP Sheridan, show that only some 285 Greek Cypriots and 68 Turkish Cypriot former "Missing" persons remains were found until now, while more than 1.464 Greek Cypriots and 494 Turkish Cypriots are "still Missing", (even many years after ECHR's Judgements condemning Turkey for failing to do any effective Investigation on Greek Cypriot "Missing" People, while also practicallyt refusing for Decades to dully inform the Victims' Families since the 1974 Ankara Army's Military Invasion and Occupation of the Northern part of the island.

On the contrary, out of about 22.400 "Missing" in Bosnia-Herzegovina, more than 13.500 were found, leaving a Minority of about 8.200 still in search. Also in Kosovo, a Majority of some 2.685 persons' remains were found, leaving a Minority of 1.753 still unaccounted for, similar to Croatia (a Majority of some 2.500 persons' remains found, leaving a Minority of 2.200 still "Missing"). It's only in the most Recent Conflicts, that of Caucasus, that Statistics show almost similar Problems as that in Cyprus, with a large Majority of "Missing" People's cases remaining still unelucidated.

- However, Cyprus is the Oldest case of "Missing" Persons treated by the CoE, whose Parliamentary Assembly issued its 1st in History Resolution on such a matter, already as early as "since 1987", "on the occasion of a debate on Cyprus' Refugees and Missing persons", when "it was the first time that we (CoE) evoked this issue", as CoE Assembly's Committee on Migration, Refugees and Population, experienced Finnish MEP Mrs Virolainen, reminded.

That's why an apparent reluctance of a Turkish Cypriot Politician to, at last, make Full and Efficient Investigations on Cyprus' "Missing" persons, surprized :

Indeed, Turkish Cypriot keynote speaker Kutlay Erk, during an exceptional "side-event" held at a CoE Room yesterday, presented as one out of 3 representatives of relatives of T/C "Missing" since 1963 or 1974, after a moving introductory call for "brotherhood" with the much more numerous Greek Cypriot Missing People's Families, (but with rather Vague explications on the reasons which might aparently have hindered him and others to lodge an official application to Cyprus' Authorities and/or at the ECHR timely), he suddenly started to express a wish to "Close" this issue, concluding even with a strange call to drop insisting for Access to Ankara's Invasion/Occupation Army's "Military Zones" in Occupied Cyprus, (among which Turkeu would have opened for access some, according to him), prefering to push researchers of Mass Graves towards other, Civil Areas, contrary to CoE's Committee of Ministers' recently reiterated Calls for Ankara's Army to allow Free Access of its Military Zones in the Occupied Territories of Cyprus. Moreover, he appeared eager to focus on CMP only, (an old "Committee on Missing Persons", set up by the UNO since 1974, vainly), which has already proved its notoriousI inefficiency, and cannot even search to find out who is Responsible for their Enforced Disappearance",

The T/C event's scheduled duration was for only 1 hour, (instead of the usual 2 hours-long CoE's side-events, between 1 and 3 o'clock pm), preceded by a 15 minutes Film and interrupted 10-15 minutes earlier, i.e. practically lasting just about Half an Hour, without sufficient Time for Debate/Questions-Replies withe the Audience (filmed by Video-Cameras), reportedly because Mr. Erk, (who was also a long-time so-called "Foreign Minister" of the illegal break-away Occupation regime set up and sustained by Turkey since its 1974 Military Invasion/Occupation), had to give an Interview to Ankara/Istanbul's TV Media...

But, in fact, as it was denounced Today by Cyprus' MEP Stella Kyriakidou, speaking on behalf of the Socialist Group, it's only recently that Turkey allowed to search just one (1) Military Zone in the Occupied Territories, so that, "concerning the Greek-Cypriot "Missing", one cannot ignore the fact that precious Time has inexcusably elapsed due to the Non-co-operative attitude of the Turkish side", because, "despite many relevant ECHR decisions, Resolutions of the Committee of Ministers and other international calls, after 4 Decades Turkey has only recently.. allowed ...to have access to a fenced military zone in the occupied areas". Therefore, "we ... hope that Turkey will ...co-operate genuinely on that matter, and fully implement all relevant ECHR's decisions", particularly by "allow(ing) unrestricted Access to all Military areas throughout Occupied Cyprus, and in Turkey itself, as well as to open its Military Archives", she concluded, reminding several relevant CoE's Committee of Ministers' vain calls to Ankara.

In this context, it was obviously Astonishing to see that the version of ICRC's Historic Exhibition on "Missing" persons presented at the CoE in Strasbourg this week, purely and simply .. Ommitted any Mention whatever to the Cyprus' cases, while, on the contrary, going as far as to show a big Photograph on freeing a few Tens of POW's after the Iraq- Iran war, but entirely Failing to even note the Fact that ICRC had helped f.ex. to Mass-Returns of many Hundreds/Thousands of Greek Cypriot POWs, previousy arrested and transfered to various Turkish mainland Jails, who finally arrived by Ships back to Cyprus on 1974-75, (but leaving some 1.800 "Missing" Persons still unaccounted for).

- A fortiori when, as Grek MEP Marias reminded, it's also "Greece (which) is directly involved concerned about the issue of Missing persons in Cyprus", since , 64 Greek Citizens are still officially recorded as "Missing", 39 Ysears after the Turkish invasion in 1974". Meanwhile, "the universal obligation of a State to "combat the Impunity" of those Responsible for the tragedy of "Missing" persons is still in place, and it was evoked by CoE's Parliamentary Assembly in its landmark report last year on "The International Convention for the Protection of all Persons from Enforced Disappearance". But "Turkey has yet to explain which Measures it has taken, and what's the Time frame of its Effective Investigations", Marias pointed out.

- Among "the Main Reasons why the problem of Missing persons has Not Yet been solved", "2" are Lack of Political Will (by States, de facto Authorities and/or Regional/International Organisations) and individuals’ Fear of Reprisals", to which "can be added" also "limited national capacity", "lack of qualified forensic experts", "Budgetary constraints", etc., CoE denounced.

- But ECHR's Judgements "clarify that States involved in relevant conflicts remain under an Obligation to solve the issue of missing persons Until a proper Investigation has been carried out", and "this means that these States can be held Accountable for Many Years After a disappearance has occurred", while "this Obligation "derives, inter alia, from the 1949 Geneva Conventions, the 2006 International Convention for the Protection of All Persons from Enforced Disappearance and Articles 2 and 3 of the European Convention on Human Rights", CoE's Assembly points out.

+ "Mechanisms dealing with the issue of missing persons" must be "independent and impartial", "NGOs (non-governmental organisations) working on the issue of Missing persons" should be "involved" in their work , which must be "supported" by States, the International Society, etc.,, while "the CoE's Comissioner for Human Rights" is "encouraged" to "Monitor.. the problem of Missing persons, as a result of Conflicts, in the Countries and Areas concerned", according to the Resolution adopted Today by CoE's PanEuropean Parliamentary Assembly.

CoE Chair, Armenian President Sargsyan: Links with EU and with Russia not opposed but complementary

*Strasbourg/CoE/Angelo Marcopolo/- Symbolically well placed, as current Chairman of the CoE, the PanEuropean Organisation due to boost Cooperation and Unity among its Members, including, mainly, through Democracy, Human Rights and Rule of Law principles, Armenian President Serzh Sargsyan, in his Speech to CoE's PanEuropean Parliamentary Assembly in Strasbourg, as well as in Reply to MEPs' questions on developments concerning EU's Eastern Partnership and Russia's EurAsian Union, stressed that instead of opposing these 2, neighbouring Regional Integration plans, as some often do recently, sometimes even too sharply, in almost Dramatic terms, on the make thecontrary, they should be made Complementary to each other, and organized in a way which coukd Fit them all in one, by "Matching the Relationships and Interests with both our Key Partners" :

A reply which obviously concerns, mutatis-mutandis, also several other European Countries, such as Belarus, Moldova, Ukraine, Georgia, Azerbaitzan, etc, at the eve of an impotant EU Summit at Vilnius scheduled to take Decisions on EU's Eastern Partnership in November.

- "We would Refuse to Built a New Relationship with any Partner, that would be aimed against any other Partner", President Sargsyan warned. - "Armenia has a Close Allied Relationship with the EU", and "we aspire to have the Closest and the Widest posssible Relationshio with Russia". "We have not built a New Relatonship at the Expense of the Relationship with our strategic Ally", he stressed from the outset, as a matter of Princple.

- In particular, "Armenia aims to Continue its comprehensive and mutally Beneficial Partnership with the EU" : "The EU is one of Armenia's most Important Partners : Wide scale of Reforms in relation to Human Rights, Democracy and Rule of Law, make up the Core of our Relationship. The Eastern Partnership instrument, created under the EU and in Coperation with the CoE, is an important initiative. It covers a variety of activities, "That Policy will Continue", he ensured.

- Because "we are not prepared to view that matter in the dimension" of a kind of ..."Civilizational Choice" of the Countries participating in the EU's Eastern Partnership", as "there has Recently been much Talk of", he warned. In fact, "We have Always stated that", and it's "from the outset of (EU's) Easter, Partnership Initiative (2009), and even Before, we have stated, and will Continue" to state that, President Sargsyan clarified.

- Replying to a Question by Swedish MEP Marietta Pourbaix-Lundin, who claimed that Armenia's decision would have been "a last minute Change", obtained after "a lot of Pressure", "not only on Armenia, but also on Ukraine, Georgia, Moldova, and Azerbaidjan", he not only firmly Denied, but also presented an absolutely Differend View of the overall situation:

- On the so-called "Pressure, it would be redundant to speak of any. ...Frankly ... no official from the Russian Federation or the (EurAsian) customs union has uttered even half a word about the need for Armenia’s accession" to that. In fact, "We (Armena) were the ones expressing that Desire, because we face a simple Reality: GFor more than 20 Years, (i.e. almost all the time that ARmenia was Independent), we have been in a Military-Security system of Countries that now form a(n EurAsian) Customs union. We canNot Isolate ourselves from the geo-Economic area in which we have operated for more than 2 Decades", Sargsyan explained.

- Most important : - "our policy is one of Matching interests, Not Conflicting interests", the Armenian President stressed, right at the Heart of the matter. Thus, "the (EU's) Eastern Partnership can always Supplement activities of Other organisations, meaning that our interests could be Complementary in this area" : "We Always told (that to) our European colleagues in the European Commission", ""From the very Beginning of the negotiations" with the EU, he reminded. And initially, "our colleagues have Agreed with us, and said that the -(EU's) Eastern Partnership is not aimed against any third party, State or organisation".

- But, curiously, it's "Unfortunately", only "After stating our intention to join the ("EurAsian") Customs union, (that) "our EU Commission colleagues said that there would be a direct Conflict, between the (EurAsian) customs union, and the (EU's) free trade agreement, as well as different Rules" (of WTO ?) , President Sargsyan denounced.

=> Therefore, "we suggested that we should therefore sign the (EU's) Association agreement, which mainly relates to Political Reforms. We have said that we are Ready and Committed to carrying out those Reforms, and we are Continuing that process", he revealed. In consequence, in this sense, "We Still stand Ready to sign an Association agreement with the EU" : "Armenia remains on Track", he confirmed.

+ Questioned, however, anew by Moldovan Liberal MEP Ana Gutu about "Armenia’s expectations for the (EU) Eastern Partnership Summit that will take place in Vilnius at the end of November", and, whether "Armenia will wish to Sign an Association agreement with the EU ?", the Armenian President made a crystal-clear Distinction :

- "We will take part in the (EU) Vilnius Summit", and "We stand fully Ready to sign the Association agreement", Sargsyan confirmed at first.

+ "But there are 2 Facets : The (EU) Association agreement, and the (EU) Deep and comprehensive Free Trade area (DCFTA)". And, "since our EU colleagues have told us that the DCFTA contradicts (Com. Supra + Infra) the (EurAsian) Customs union treaties, we anticipate that we will sign Only the (-EU) Association agreement", he supposed.

- Indeed, " The Association agreement, and reforms to be taken under it, are the Nexus of our relationship with the EU. The main document is the Association agreement", (closer to CoE's own mission to boost Legal Reforms for the protection of Human Rights, Democracy and Rule of Law).

=> In consequence, "in the run-up to it (EU's Vilnius Summit) , our expectation is that Changes will be made to the Negotiating Document" accordingly. In this sense, "We would like to be in Vilnius, and would like to sign the association agreement", (i.e. by taking into account the above-mentioned Distinction : See Supra).

+ A last Question by French "Socialist" MEP ... Fournier, incited the Armenian President to Sum up :

- "This situation seems to be jeopardising the European (EU) Free Trade Agreement that your country had been planning to sign at the (EU) Eastern Partnership Summit at the end of November. What Plans do you have for Relations between your country and the EU ?", Fournier asked.

+ Let me reiterate : the Policy is one of Complementarity (f.ex. between EU's Eastern Partnership, and EurAsian Union, etc). From the very beginning of the EU's Eastern Partnership talks, we agreed with our EU colleagues that our relationship with the European Union would not be promoted at the expense of any existing relationship with our Allies (Russia, etc)On the contrary, "our relationship with the EU would Complement our relationship with Other organisations", (as, f.ex. the EurAsian union, etc).

- For more than 3 years, that was the mutual Understanding". But, "I Regret that, (recently) our colleagues in the EU deemed a(n EU) Free Trade agreement Incompatible with our accession to the (EurAsian) customs union", he critcized anew.

=> Therefore, now, "We are Talking to our colleagues in the EU, about what kind of Document we may be able to Sign", since "we will continue to develop our relationship with the European Union", and "we will go to Vilnius"' EU Summit. In particular, "the (EU) Association agreement is about not only a free Trade area, but, primarily and fundamentally, Political Reform. ... We (Armenia) will Continue such Reforms, and that we stand Ready to Sign that Part of the (EU) Association agreement in Vilnius" Summit, Sangsyan explained anew.

Something which, obviously, unveils an Original Situation : Contrary to what Other Neighbouring Countries use to do : I.e. Accept to make Democratic and other Reforms in order to become able to benefit from a lucrative Economic Deal with the EU, on the Contrary, here, an Eastern Neighbouring Country like Armenia feels obliged to suggest to accept Reforms even withou getting, in exchange, any Economoic (Trade) Deal with the EU, (since it would be obliged, according to some hasty interpretations reportedly made by EU Commission in Brussels), to drop the EU's "Free Trade" component, because it would be "incompatible" with Russia's EurAsian Customs Union, (reportedly, according to EU Commission's sources).

EU Commissioner for Enlargment and Neighborhood policy, Stefan Füle, had apparently accepted at least the Principle of that :

- "We (EU) stand ready to do all we can ...to work with our Neighbours to Find Ways of maximising the Compatibility between the EU and Eurasian structures", and, particularly, "in a way that facilitates Trade and economic Integration to the benefit of our neighbours, and also to the benefit of our neighbours’ neighbour", as he had declared, recently at EU Parliament's last Plenary, September 2013 in Strasbourg. Because, "I am a great believer in the Win-Win approach, particularly when dealing with such an important, privileged and strategic partner as Russia. I am definitely Not in the business of creating New Wars", Fule denounced.

"On the contrary, Transformation is the rule of the game. The Association Agreement, including this Deep and Comprehensive Free Trade Area (DCFTA), is a most powerful instrument of that transformation. That is why the Vilnius (EU) Summit, and the preparations for the eventual signing and initialling of this agreement are so important. The rule of the game is not to lower the bars or to forget about conditionality, but to offer a more Strategic engagement with our partners.

- Fule reminded that 2004 led to the development of so-called ‘deep and comprehensive Free trade areas’ (DCFTAs) as an integral part of the new enhanced agreements subsequently known as Association agreements proposed in 2006. at the Prague Summit establishing the Eastern Partnership in 2009 and confirming our joint objective of Political Association and Economic Integration underpinned by those Association agreements(A) /deep and comprehensive Free Trade areas (B)".The Prague Summit established the Eastern Partnership in 2009 and confirmed our joint objective of Political association and Economic integration underpinned by those association agreements/deep and comprehensive free trade areas.

- But, "EU Standards and norms ... are currently Not always Identical with ...those of the (EurAsian) Customs Union", particularly concerning "External Trade policy", Füle pointed out; without explaining clearly from which point of view. Earlier, he had obserbed, in this regard, that :

>>> - "It is true that (EurAsian) Customs Union membership is Not Compatible with the DCFTA which we have negotiated with Ukraine, the Republic of Moldova, George and Armenia. This is not because of some ideological differences. ...This is due to Legal impossibilities. F.ex. ou cannot at the same time Lower your Customs Triffs as per the (EU's) DCFTA, and Increase them as a result of (EurAsian) Customs Union membership", Fule warned.

+ Howewer, he also stressed, that "It May certainly be Possible for members of the (EU) Eastern Partnership to increase their cooperation with the (EurAsian) Customs Union, perhaps as observers"...participation in a DCFTA is of course fully Compatible ......with our partners’ existing (?) free trade agreements with other Commonwealth of Independent States’ organisations.

- That's why, "we are already actively Cooperating with Russia on the Alignment of many Norms and Standards", as ....a key element of the EU-Russia Partnership for Modernisation", so that "these standards are also increasingly being Adopted by the (EurAsian) Customs Union": Meanwhile, . EU "Norms are ..., of course, fully compatible with WTO rules. So the EU is actually helping all its partners, including Russia, to ...Open up to Globalisation", as he said, (probably hinting at Lower Taxes at the Borders, easing Foreign Trade)...

=> Therefore, "We have always added that we stand ready to help our Partners, and if necessary Moscow as well, to FIT "the policies of the Customs Union and the Eurasian Union", he promissed.

=> "Our Vision is that these agreements should contribute in the long-term to the eventual creation of a Common Economic Space from Lisbon to Vladivostok, based on WTO rules", highighted Fühle. "THE issue is ameliorate and develop EU- Russia Deal in a commonly agreed Greater Europe, facing a growing Global Competition"

"So we encourage our partners to Deepen their Ties with Russia, as we do ourselves, but in a way which is Compatible with the (EU) Association agreement, and ....Free Rrade areas’ obligations. The EU is ready to work with its neighbours to Find ways to promote greater regulatory Convergence between EU Member States and the (EurAsian) Customs Union", Fule proposed, but without making it clear whether he meant to Lower Customs' tariffs, or not)...

"...... The Last thing we want to see is a Protectionist Wall cutting our continent in two. In today’s ever more competitive global economy we cannot afford to vwaste our efforts on a regional geopolitical Rivalry", he concluded.

+ The issue inevitably raised also Questions about some, old or new, EU Commission's controversial moves, if not guided by a conscious Strategy, at least, apparently provoking a series of Negative results against European Integration, perhaps as a quasi-automatic consequence of a too rigid stance mainly on Common Market related points :

All sincere and conscious European Citizens certainly don't like the fact that unequestionably European Countries, (from the point of view of their Culture, History, Geography, development, ties, shared Values, etc), such as Schwitzerland, Norway, etc. and recently even Iceland, (not to mention the way to treat Ukraine, or even the particular case of great Russia itself, etc), have droped, at least for the time being, any project to join the EU in the foreseable Future, (even if they want to have very Close Links with the EU, often in Economy, Science, etc., and sometimes even on Schengen's free movement and security rules, etc), often after Referenda and/or Elections where Voters were apparently dissuaded too often by comparatively "secondary" maters, such as, f.ex. the fear that noisy and poluting Lorries and Trucks might cross the splendid Swiss Natural Landscapes, or that Fishing Quota disputes would deprive Iceland from one of its most important, traditional resources of real economy, etc.. So that finally, (with the only exception, perhaps, of Serbia and other Western Balkan Countries), it's .. only Turkey (sic !) which apparently still persists in its controversial and unpopular EU bid.... Not something that would provoke enthousiasm to the European People, isn't it ? What went wrong, and who was really responsible for siuch facts, (which must obviously be changed the soonest) ?

"EuroFora" never was really fan of Romanian ex-"Socialist" (currenytly Independent) politician Mr. Severin in the Past, but, simply by reading now what he recently denounced in Strasbourg, precisely during the latest EU Parliament's debate on the topical issue of Countries like Armenia, Ukraine, Belarus, Azerbaidjan, Moldova, etc., pushed and pulled between EU's Eastern Partnership and Russia's EurAsian plans, are not without interest :

- "Adrian Severin (NI). - ...the fact that Russia wants to attract its neighbours to come under its leadership in the Eurasian Union is understandable. The EU also likes to have its neighbours together with it. The real question is why, after experiencing the European Union Eastern Partnership, countries like Armenia opt for the Eurasian Union. It is not only to do with pressure from the others. It is to do with our own (EU's) weaknesses". F.ex., "the Georgian Prime Minister apparently considered the same option. Belarus was lost because of the dogmatic shortcomings of some of our policies. Azerbaijan will be lost because the EU is not able to see the strategic importance of that country, which is not looking for money but for a serious political partnership and its territorial integrity. When Russia puts pressure on Ukraine for not signing the Association Agreement with us, it knows something that we apparently do not know, namely that Ukraine is strategically crucial ...... How long do we think that rejecting and harassing the Ukraine, Ukraine could remain neutral? ....It is useless to blame Russia. Instead we must be more robust and pragmatic in our policy. .....If we are always raising all kinds of Conditionalities, instead of trying to bring these countries together in our camp, certainly the other pressures will be fruitful. This is our fault and we have to avoid it in the future. We certainly could criticise Russia, but I believe we should als look in our own yard to see our own mistakes". OECD SG Gurria to EuroFora: China's Growth=sustainable, but Political Action needed, as in the West

*Strasbourg/CoE/Angelo Marcopolo/- China is a positive "exception", even among BRICS Countries, and its big Growth looks Sustainable, said OECD's Secretary General, Angel Gurria, to "EuroFora", shortly after having denounced an Insufficient yet "Moderate Recovery" in Advanced Countries, but also a recent aggravatrion of Inequalities, and other such facts which clearly indicate the importance of an also Political dimension in the way out of the Global Crisis.

Growth in BRICS' Countries can contribute to advance towards a Global Recovery of the World Economy out of the recent Crisis

In general, BRICS Countruies go quite well, even if, recently, there was a Deceleration, particularly in some of them.

In fact, it looks like a Paradox : While, until now, it was the BRICS and other emergung Countries which were the main Driving force, even during the Global Crisis, nevertheless, now, the tendency is for the Economic situation to start ameliorating in developed areas including Europe, etc., while, on the contrary, some BRICS Countries face problems :

F.ex., in South Africa, Growth's development was Negative recently, for the first time after any years, and something similar seems to looms ove India, perhaps Brazil, etc, he pointed out.

However, in Russia, growth looks rather stable, and, in fact, China is the only Exception, with a big and steady Growth of + 7,5%.

And it really appears to be a Sustainable Growth, that we should all try to contribute to maintain, (for an obvious Global Interest), the experienced Head of the International Economic Organisatio optimistically prognosticated.

But there is no Secret, about the possible causes of this Chinese Growth : In order to ensure that it will be really Sustainable, China should advance in its Reforms, particularly by passing from an Investment-driven model, into a Consumption-driven one, Gurria advised, i.e. practically endorsing the Official Policy currently promoted by China's New Political Leadership.

+ Another characteristic of the new Chinese Leadership's anounced intentions notoriously is also to Curb and Reduce the recently aggravated Economic Inequalities between various Groups of the Population, and this is even more true in Advanced Ecoonomies of Western and other Coutries :

- it's not only China, but also many Western and other Countries which must also pay Attention to Aggravating Inequalities, OECD's Head warned in his Speech, earlier Today, at CoE's Parliamentary Assembly :

Even if, in general, "the economic outlook is a little brighter", with a "Moderate Recovery in the major Advanced economies of North America, Japan and the UK", while "the Euro area as a whole is Out of Recession, although output remains weak in a number of countries", nevertheless, Revenue Gaps are growing :

- F.ex., "Today in OECD countries the average income of the richest 10% of the population is approximately 9 times higher than that of the poorest 10%; while it was just 7 times higher 25 years ago. So inequality has grown by about 30% in one generation !"

Even in economies like Germany, Denmark and Sweden the income gap between rich and poor is expanding, from five to one in the 1980s, to six or seven to one today. In Chile and Mexico the rate is 27 to one, in Brazil it is 50 to one, and in South Africa it is maybe triple digits"...

+ In addition, the factors of inequality stretch beyond income., affecting even "Health and Education" : less educated and lower-income individuals live Shorter Lives, are less politically active, and have Children with Lower School performance, so this tends to perpetuate itself, he denounced.

=> This inevitably raises questions on the Democratic Legitimacy to various Governments, some of whom risk to lose the "Trust of the People", Angel Gurria warned, stressing particularly this point.

+ At the same time, Today, ...we wake up to the idea that USA does not have funding for its government, and that we may or not have a government in Italy, and there is also the formation of a government in Germany, (etc). So "the Political superstructure is affecting this recovery picture" in Economy, OECD's Chief concluded.

By a "coincidence", it was also the 1st time that OECD's Economic Report to CoE's PanEUropean Parliamentary Assembly was prepared in the framework of its ..Political affairs Committee, instead of the Economic affairs' one, a CoE's Official observed to "EuroFora".

Russian Duma Chief Nashyrkin tests EuroFora idea on Citizen-MP Debate before Decision,+Coop.CoE/WFD+

*Strasbourg/CoE/Angelo Marcopolo/- Speaking to Journalists at the CoE, including "EuroFora", Russian Parliament's President, Sergey Naryshkin, after a landmark Speech at CoE's PanEuropean Assembly, presented a new 2012-2014 Project to develop "E-Democracy" in real practice, coherent with "EuroFora" Founders' 1997-2007+ main idea to boost active participation of Citizens in Public Debates during the Decision-making process of Measures affecting People's lives, by adequate use of Internet and Compuiter Technologies, (Comp. "EuroFora"s basic, introductory texts, and "EIW" collective project officially registered by EU Commission in Brussels as early as since 1997, in the framework of a tender for the "ESPRIT" programme for innovative social uses of New Information and Communication Technologies).

Timely, President Naryshkin's move was made in Strasbourg, almost at the eve of CoE's 2013 Annual "World Forum for Democracy", scheduled for November, which is, for the 1st time, dedicated, precisely into "Re-wiring Democracy" by "connecting institutions and citizens in the digital age", according to its official sub-titles, aiming to look into opportunites and risks of a number of Participatory Initiatives, test their solidity and longevity, in an open debate with elected politicians, according to CoE's official anouncement. Meanwhile, the concrete points of the Russian Initiative were presented during a special Event organized this week at the CoE (See Infra).

+ Pointing also at "the growing Responsibility that has been bestowed on European Parliaments", as clearly indicate the "Dramatic Moments of our History" that we are living Today, f.ex. vis a vis "events on Syria", (including the famous Brittish Parliament's Vote, which recently forbidded Air Strikes against Syria), which highlight that Threats to the World Order are related to Defiance of the Law and Principles which were founded here, on the European Cointinent , at the aftermath of 2 World Wars, during which, the Centuries-old European commitment to Humanist Values that unfderpin Legal Systems, had been bypassed by Crimes against Humanity, frrom the Armenian Genocide and the Horrors of the 1st World War, up to the NAZIsm and the 2nd World War, Naryshkin stressed, earlier, speaking to MEPs, that "People around the Worls are following the events in Europe, because it was on European soil that the Great Discoiveries and Technological Breajthroughs were made, and Legal or Socio-Political Theories emerged, leading to Progress, Freedom and Dignity of Human Life".

- In general, I thought that this was the Time for Ideas to be Heard, and to be Positively received, and, indeed, during my Meetings with CoE Parliamentary Assembly's Presiden Jean-Claude Mignon, and CoE's Secretary General Thorbjorn Jagland, as well as during my Speech, earlier to MEPs, I saw that the Issues that I raised, are clearly Understood, and sometimes Appreciated, even if "we also looked at various areas that Need Improvement", the Russian Duma's President told Journalists, including "EuroFora", at the conclusion of his Strasbourg's visit.

Asked what kind of Ideas had he tried to convey here, Presiden Naryshkin recalled that, during my intervention, at CoE's Paneuropean Parliamentary Assembly (PACE), I also spoke about the Challenges raised Today", (which included also the "E-Democracy" Project of the Duma), We (Russia) value the activities of the CoE and of its Parliamentary Assembly. We believe "that these are very Important ...Institutions, which are Beneficial for our Cooperation, and deal with Democracy". Thus, "there is No Doubt about the Fact that, while we are developing this .. we will also be Focusing on .... to Challenges and Issues, that we have to solve in the process of these, very demanding activities", as he said; shortly after having previously presented "E-Democracy", precisely, as one of these "Challenges".

=> Therefore, "out visit will Move Forward" some "very Important Issues", that we discussed while looking ahead. Thete is no doubt that in such Important issues, we can Work Further", and that, therefore, we can Accomplish much more. Because, "Today, the situation is Changing", and "we are facing the New Issues, (such as "Syria", "E-Democracy", etc), and "we are looking at .. Open Talks, and for Discussing the System of Law that exists Today, (including also) of International Organizations, .. of Global Politics, (etc). Therefore, the role of the Parliamentary Assembly of the CoE, of all those forces that are working in this area, becomes so great, that, this was the Time to come" to Strasbourg, he explained. In consequence, out meetings are a good demonstration of (the fact) that our Parliamentary Cooperation, and the Role of the CoE, will Expand", anounced the President of the Russian Parliament to Strasbourg's Journalists, including "EuroFora",

After PACE's President Jean-Claude Mignon, also COE's Secretary General, Thornbjorn Jagland told us that, during what he qualified as "a very Constructive meeting" with Naryshkin, "we have Started to Discuss various Projects of Cooperation, between the CoE and the Russian Federation", "on various matters", and, "all in all, I would like to say that Cooperation ....is on a very Good track" , as he concluded.

In particular, convinced that Parliamentary Democracy, which emerged in Europe Thousands of Years ago, is playing an increasingly Important role in Today's World, President Naryshkin expressed his belief that Representative Democracy is a Time-tested and Necessary Institution, also for the functioning of Modern States.

However, one of the Main Challenges which determine both our Mutual Undestanding, throughout all the Continent of the Great Europe, but also the content of our Agenda, as he stressed, is the fact that the Modern Legislative Process canNot be, no more, conducted behind Closed Doors, its Access cac no longer be confined to the "chosen Few", he warned.

>>> On the contrary, Today, not only "this process should be made Transparent to the Public", but, evenmore, "it should be subjected to Dialogue, throughout the Deliberation" , stressed, earier in his Speech to CoE's Assembly, President Narushkin, pointing at the various Legal Draft Bills (tabled by MPs or by the Government) and/or Initiatives (lodged by Citizens, almost like the EU Citizens' initiative, introduced by EU Lisbon Treaty after 2010, but existing in a much Simpler way in the Duma, as Russian sources confirmed earlier to "EuroFora").

Experience teaches us, f.ex., that "it is often the Lack of Feedback, of Dialogue, that makes People Question the Legitimacy of Government Decisions, and the Fairness of Courts' rulings, he observed.

But, Today, some Internet portails inculcate People with the idea of Individual Freedom, which, in fact means to depend only on the Law, as the Historic French Philosopher of the Enlightnement, Voltaire had hghlighted, while New Communication Technologies have more and more an Important Influence on our Political Agenda, when we are faced with the Challenge of a Virtual World, with its own Public Opinion Techniques, transcending National Borders, and built in parallel with Traditional Parliamentary and other Institutions of Democracy, by forming many Interest Groups and popular Debate Forums, noted Naryshkin.

Even if some People consider that the development of the Internet Age would signify the Demise of Classic Parliamentary Democracy, since Social Networks are considered to be now a mouthpiece of the People, with undoubted Influence.

But, on the contrary, I believe that, in such circonstances, the Responsibility of Parliaments has become even more Important, Russian Duma's President stressed.

=> Because this new trend seems likely to continue unfolding, until, sometimes in the Future, "New, Electronic Democracy" realities emerge, with its own Procedures and Legal Forms, Narushkin foresaw.

However, in the meantime, thy have to pass the Test of the Time, and be proven Error-Free, in order to avoid any eventual risk to the detriment of future generations, he warned.

Obviously, that's one more reason for which the Russian Duma has recenty taken the decision to start experimenting and even systematically using in real practice, such Internet-facilitated EU Citizens' involvement in timely Dialogues with MPs and Governments before decisions which affect their lives are taken, while also it is interested into developing exchanges of views, and/or common projects with various other, National, Regional or International Parliamentary Organisations, as Serguey Narushkin suggested, pointing at Inter-Parliamentaruy cooperation, Scientific Research in Law and Politics etc.,, Socio-Political Experimentation and/or Theorisation, etc.

In fact, the "e-Democracy" Project, supported by the Russian Government, started with the newly-elected Duma from 2012, with a 1st Implementation stage in 2013, and the aim to have completed most of its parts by the end of 2014.

Citizens can not only know what Measures are prepared in the Parliament, and follow them, from the 1st Reading of a Draft Bill, throughout all the Decision-Making Process, up to Final Adoption, but they can also Participate Actively, by raising relevant Questions to MPs and receiving their Answers, by eventually suggesting Amendments which can be taken partly or entirely into account and officially tabled by MPs, by presenting "Initiatives" which can be Voted On-line, and eventually accepted, in all or in part, in order to form New Draft Bills, as well as by joining Public Forums of Discussion, dedicated to one or another Draft Bill, which are to be maintained by each Parliamentary Committee competent for the discussed Draft Bill, as Duma's competent Officials told previously "EuroFora", after a special presentation for MPs, PACE Officials and Journalists organised at the CoE by Duma's vice-President Lebedev.

Well informed Russian sources close to the President of the Duma, indicated to "EuroFora" that, in fact, such an idea of Debates between Citizens and Political Decision-making bodies before important measures affecting their lives are taken, apparently reminds also an Ancient Russian custom, which woud have eventually emerged, in different forms, already as early as after the 12th Century AC, (i.e. basically after the Brittish "Bill of Rights", etc). I.e. probably at the begining of the Historic emergence in Europe of a kind of "Public space" (German Political Philosophe Jurgen Habermas' "Öffentlichkeit"), as if its main substance was, right from the start, embedded inside what became, later-on, the Public Adinistration in itself, as "EuroFora"'s co-Founder had discovered in the framework of a Scientific Research on Administrative Law in Europe.

Austrian People slam Soc-EPP big Coalition, give 60% Majority to the Right, and/or with Greens (70%)

*Strasbourg/- In the 2nd EU Country to make possible a New Governing Coalition between the Center-Right and "Green" Parties, after Germany last week (See : http://www.eurofora.net/newsflashes/news/germanelectionresultsandprospects.html), the Austrian People clearly slamed the out-going "big" coalition of "Socialists" and Christiandemocrats, (the formerly leading "Socialists" bearing heavier losses), but gave a Strong Boost to a large Center-Right Majority of various Parties, (as an alternative for a New Coalition which could be led by the Christiandemocrats), able to total almost ...60 % of Citizens' Votes (see Infra) !

At the central European Country which is due to Chair the PanEuropean Strasbourg's Organization of the CoE from November 2013 up to May 2014, the ChristianDemocrats (EPP) of Foreign Minister Spindelegger's ÖVP, even if they pay a price for an "unholy", but usual in Austria's Past, coalition with the "Socialists", by getting about - 2% less, nevertheless, they Keep 24% of the Votes casted in the Country, and -what is the most important- they have now a Strategic "Pivot" position, at the overall Political ChessBoard, from where they can Choose 1 out of 2 differend Coalition Governments theoretically possible from now-on :

Either persist by returning back at the ÖVP - SPÖ, Christiandemocrats - "Socialists" coalition of the Past, with slightly more than just +50% of the Votes casted for both : Something apparently incompatible with Spindelegger's declared wish to become Austria's new "Chancellor" (an aim for which ÖVP officially campained this time), because the "Sociaists" keep a Small edge with + 2,9% more votes, and also at variance with another will expressed by the ÖVP during this 2013 Electoral campaign : That of fighting against Corruption, (a future Austrian CoE Presidency Priority, for the period of November 2013 - May 2014, as experienced Chairman of Tirol's LandTag Pariament, fomer Governor, and current President of CoE's Congress of Local/Regional Authorities, Herwig Van Staa has earlier revealed to Strasbourg's Journalists, including "EuroFora" : Comp. for the latest Van Staa's replies to "EuroFora"s Questions at : ...), that they mainly denounced as a fact affecting mainly the SPÖ's "Socialists.

Or, otherwise, the ChristianDemocrats now have a crystal-clear chance to accept an Alternative, New Alliance; together with FPO's Rightists led by Strache, which are a Big Winner of the 2013's Election, gaining + 3 %, so that they come Close Next to the ChristianDemocrats of the ÖVP with nearly 21%, as well as with the Brand New Center-Right Party of Billionaire Stronach : "Frank", which are the 1st Biggest Winner of fresh Votes on 2013, with nearly + 6 %, and the Surprisingly efficient "NEOS"'s almost 5% : A relatively New Party comming from the "LIberal Forum" which was a split from the Rightist FPÖ founded by Haider and now headed by Strache, therefore considered to be at the (Center)-Right side of Austria's Political Spectrum.

This Total could reach almost 60% of the Votes casted (+58,8%), i.e. a crystal-clear Absolute Majority of votes given by Austrian People to the Right side of the poliical spectrum, if one counts also the 3,5% obtained by BZÖ rightist party, founded (as also initially the FPÖ) by Heider, who was meanwhile killed by a Car crash. Even if the BZÖ narrowly missed this time its entry to the Parliament by just 0,5%, nevertheless, the above mentioned Center-Right Parties' new Coalition could obtain easily a Governing Majority also of MPs, by adding ÖVP's 47, to FPÖ's 40, and Frank's 11, together with NEOS' 9, i.e. a Total of 107 MPs

Another Variant for such a New Government Coalition based on the ChristianDemocrats of the ÖVP, which became possible on 2013, would be to include also the "Greens", which won 12,3% of he Votes (+ 1,9% more), and 24 MPs. If necessary, the fact that Austrian "Greens" are notoriously composed from Various Components, of Different Political Origins and at Different Areas, (some of which are inserted inside or adjacent to ChristianDemocrats/ÖVP's own areas, as f.ex. at Tyrol's Region, and/or in Vienna City Center, etc), as well that "Greens" reportedly are currently the only Austrian Party untouched yet by any Corruption affair, so that they would "fit" well with Christiandemocrats/ÖVP's wish for an Anti-Corruption policy, could certainly help a "Black-Green" Coalition, (together with some among the above-mentioned other Center-Right Parties), in extension of a possibly similar developmeny at nearby Germany (Comp. : ...). In that case, the Total of Votes which could be attracted around the ChristianDemocrats of the ÖVP would reach more than 71%, (with 131 MPs) !

On the contrary, the "Socialists" of the SPÖ, reportedly affected by most Corruption Scandals and bearing the main Responsibility for the Out-Going -Government which was headed by their Leader Faymann, logically loose the most of voters, among the out-going Coalition, ( -2,4% instead of -2% for VPÖ), and they also Loose the 1st place at the central BundesLand of Steiermark, now Won by the Rightists of the FPÖ. (which jumps up for almost +7% of the votes, reaching more than 24,1% in that area, able to form a Majority together with the ChristianDemocrats of the ÖVP : nearly 21%, and/or the other Winner : the "Frank" Party of Billionaire Stronach : + 10% there for the 1st time, followed by the other Rightists of BZÖ and the new Party of Center-Right : NEOS, with almost 4% each, the "Greens" having in Steiermark  10,5%).

But the most Important seems to be the fact that, in the overall National Elections' results for all Austria, the "Sociaists" of SPÖ become now even more clearly Isolated accros the Political Spectrum, since they can't normally find any other Party leaning towards the Left side, except only a Tiny "Communist" Party : "KPÖ". with just a Small 1%....

Even if they searched to find a Coalition with the "Greens", that would be not only Insufficient, (given the fact that, taken together, the "Socialists" of the SPÖ and the "Greens" would have a Minority of only 38,5% of the Votes, and just 75 MPs), but also rather Improbable, (inter alia also because the "Greens" would obviously be ill-advised to Drop their currently No 1 "Moral" Advantage : the fact that they reportedly are the only pre-existing Party which has not yet been touched by cases of Corruption, so that it's not at their interest to loose such a positive aura by eventually compromising themselves with what is considered by many commentators as the most Corruption-stricken party of the Country at present)...

(Merkel and Spindelegger met, earlier on Summer, at an EPP Summit in Vienna, under the shade of a big "Green" Tree : Premonitory Symbolism of a possible Future ?)...

Obviously, mutatis-mutandis, this is the 2nd time in a row of succesive Elections in Central EU Countries, like Austria now, and Germany last week, that, for the 1st time, an eventual "Red-Green" Coalition, between "Socialists" and "Greens" seems totally Insufficient, and sometimes even Imprbable, while, on the contrary, a "Black-Green" Coalition appears to be not only Possible but also Sufficient in order to succesfully form a New Govenrment. However, in Austria's case, this can be largely obtained also by simply adding together all the Center-Right wing parties (Comp. Supra).

It's only at Tirol's BundesLand region that the Out-going Coalition of "Socialists" with ChristianDemocrats doesn't lose votes. But, in fact, there it's exceptionaly the ..Christiandemocrats of ÖVP who were and still are Leading the coalition. Moreover, they advance in 2013 by winning + 1,2% of the Votes, while the "Socialists" of the SPÖ almost stagnate, with only +0,4% and just 18,3%  and Lose the 2nd place, taken now by the Rightists of FPÖ which wins +2,4% of votes, reaching there 19,4%,  (in addition, naturally of the emergence of "FRANK", as well as of the "NEOS" new Center-Right Parties, and "Greens" advance). Something which might be interpreted as another signal of the fact that, after all, VPÖ's declared aim to Lead, f.ex. by revendicating for Spindelegger the role of Chancellor, in fact, perhaps wasn't a bad idea...

ECHR's President to "EuroFora" on Journalists Gongadze and Adali murders : Principles must apply to all States, without discrimination.


+ ECHR's Statistics on Freedom of Expression (See below).


 European Court of Human Rights' President, Jean-Paul Costa, questioned by "EuroFora" on Journalists' murders, as in Gongadze and Adali's cases etc., strongly stressed all CoE Member States' obligation to make efficient Investigations to find and punish those responsible, and underlined that ECHR's case-law's principles must apply to all without any discrimination.

His call was clearly supported by various Top MEPs who denounced a risk of "Double Standards" if some Journalists' murders are investigated, while others don't.

To avoid such risks, CoE's Parliamentary Assembly adopted a Resolution, on the occasion of Ukranian Journalist Gongadze's murder, "stressing", as a matter of general Principle, "the importance it attaches to the safety of Journalists and political activists, especially those linked to opposition groups, in ALL member states of the CoE". All "crimes against journalists and political activists must be investigated ... as a matter of priority, without political interference".

Costa was replying to "EuroFora"s question on the fact that, after CoE's Committee of Ministers, also CoE's Assembly had just adopted a Resolution on Gongadze murder case, based on an ECHR's judgement of 2005, asking a full Investigation from Ukraine, who has found and condemned  in 10 years of jail 2 executants, but not yet the instigators.

While nothing similar was yet done for dissident Turkish Cypriot Kutlu Adali's murder, with 5 bullets shot at his head out of his Family's home in the territories of Cyprus occupied by Ankara's army, despite another ECHR's judgement of the same year 2005, and despite Turkey's claim that nobody was found among those responsible for the murder, and that there was nothing more to do..

In order to be credible and efficient, CoE's mechanisms shouldn't find a way to at least ask for full investigations of all Journalists' murders anywhere they might be committed, without exceptions ?

- "On the larger question that you raised, I'd like to say, since we are in a period of stock-taking on ECHR's 50 Years, that the Court's case-law developed certain concepts ....such as the Positive obligations of States, part of which are also the procedural obligations", started to reply ECHR's President.

 - "Whenever Journalists, Lawyers, Defenders of Human Rights, or even simple Citizens are murdered, the States are held responsible, not only if its their own security forces' agents who committed these murders, but also if they didn't make sufficiently substantial and efficient Investigations", he stressed.

- "I want to strongly underline that we (ECHR) have found in many cases numerous violations of Articles 2 and 3 against States, ....(about) murders or torture, ...because they didn't make enough Investigations in order to try to find and punish those responsible".

- "We (ECHR) do that vis-a-vis all 47 (CoE) Member States, without any discrimination".

"Naturally, the circumstances in each particular case may be differend, and we can't ommit to apply the rules of proof, or the rules of criminal procedure".

"But we try, by all means, to apply these principles of our case-law, to all States", he concluded.

      Costa's call was strongly supported by several Top CoE MEPs, from various Political areas


- "To investigate the murder of one Journalist, and not of another, looks like Double Standards", denounced the President of EuroLeft Group in CoE's Assembly, Dutch MEP Tiny Cox.  

- "What is the reason ? Politics or specificity of a case ? Of course, if Cyprus and Turkey are involved, it's always a Political case"..

- "Murders of Journalists should always be fully investigated, because killing Journalists is not only killing persons, but also killing Free Press".  "We (CoE's Assembly) should do our outmost to help People who are working on Free Press and they are under threat or murdered".

Because for Free Politics, Free Press is a pre-requisitive : Parliamentarians  cannot  function without a Free Press. Not investigating, is not protecting ourselves".

So we should investigate all Journalists' murders : We are talking about Gongadze, about the Cypriot man (Adali), about the Journalist murdered in Moscow one week ago, etc", Cox concluded

- "CoE can' look at these cases differently. CoE can't wear Blinckers  !".
- "If the one is investigated, so has to be also the other. Why there wasn't full investigation ? Why's that ?", wondered British  Socialist MEP, Alan Meale.

- "A good idea" would be to "make a Motion for Resolution", and "join all Journalists' murders. Adali and Gongadze etc", said to "EuroFora" EU Parliament Political affairs Committee's President, Goran Lindbland, ChristianDemocrat MEP from Sweden.

ECHR's Statistics on Freedom of Expression :


    Almost Half of condemnations by ECHR for violations of Freedom of Expression in 2008, concern Turkey : 20 out of a total of 48 for all CoE's Member States.

    Russia, Poland, France and Moldova were condemned only 3 times. Romania, Greece, Portugal, 2 times, and the other CoE Member States only 1 time, or none.

    During the last Decade : 1998 - 2008, Turkey was condemned for violating Freedom of Expression in ..169 cases, while Austria only in 24.

    France and Moldova in 14 and 13, respectively, closely followed by Russia and Poland with 11 and 10, respectively. The rest of CoE Member States had less than ten condemnations.
