New ECHR President Raimondi to Eurofora: Grave Human Rights Violations in Cyprus canNot be Forgotten

*Strasbourg/ECHR/Angelo Marcopolo/- Questioned by "Eurofora" on the latest developments about Cyprus' "Missing" Persons and Refugees, the New President of ECHR, Guido Raimondi, stressed that, at any case, such serious Human Rights' Violations "canNot be Forgotten" by anyone, shortly after anouncing a relevant Top Level Seminar, including War Crimes and Crimes against Humanity, etc., while also clearly underlying anew all 47 CoE Member States' 'Fundamental" Obligation to Implement ECHR's Judgements,  


"Eurofora" basicaly reminded the Fact that ECHR's Great Chamber, had given a Strong Boost, 1 r 2 Years ago (2014), on the Need to really apply the PanEuropean Court's Decisions condemning Ankara for Continuing serious Violations in Cyprus, since the 1974 Turkish Military Invasion and Occupation of the Nortrhern Part of the Island, including more than 1.500 People gone "MISSING", without anyone having been held Accountable for  any of such Horrible Crimes yet, while, in parallel, some 190.000 Greek Cypriot Refugees (almost 20% of Cyprus' Population) were still Hindered, by the Turkish Occupation Army, both to Return to their Ancestral Lands, and/or to simply recover their Family Homes and Private Property, that they practicaly saw being Exploited each day by Turkish Settlers, despite several ECHR Judgements condemning Turkey for such Massive Violations, and asking it to Stop them, already since 1996 - 2001, etc. But, after a Short ReVival of the Implementation process inside the competent CoE's body, its Committee of Ministers, nevertheless, during the Latest Period, nobody among the concerned People hadn't seen any visible mark of progress ppppTurkey's obligation to abide by ECHR's rulings, whatever...


- At any case, such Serious Violations of Human Rights, as those found by ECHR in Cyprus, "canNot be Forgotten" by anyone, simultnaously agreed in response, almost at the same thrust, both the New ECHR's President, Raimondi, and ECHR Secretariat's Director ("Registrar"), Roderick Liddell, an Experienced and able CoE's Senior Officer, well known to "Eurofora" since Decades, for these and various other Human Rights issues.


+ Moreover, New ECHR President Raimondi, spontaneously reacted to the above mentiond "Eurofora"s Query by immediately seeking to ensure whether it included, indeed, the famous "Varnava" case about Greek Cypriot "MISSING" Persons, crystalized in a landmark ECHR Judgement of 2010, (arfter which, emerged also several other cases of People taken Alive by Turkish Military, but Found later-on atrociously Killed and their Bones Hidden in Mass Graves or thrown deep down into Wells, etc, including that of a Baby with his Mother and Sisters, etc. See, f.ex., relevant Statements to "Eurofora" by the CoE Parliamentary Assemly's President, at : ...).


++ Interestingly, Raimondi had just anounced, earlier, an Important Seminar, organized by the ECHR Tomorrow in Strasbourg, about "International and National Courts confronting Large Scale Violations of Human Rights", which included, as Item "Number 1", cases of "Genocide, Crimes against Humanity, and War Crimes", with one of the Key note Speakers being Judge Piotr Hofmanski, from the International Criminal Court, as he pointed out.


In addition to the cold-blood Murders of defenseless P.O.W.s and/or innocent Civilian People gone "MISSING", (comp Supra), obviously, Turkey might also Face on Cyprus another "War Crime" accusation, under ICC's Charter, about the Massive Replacement of the Ancestral and Lawful Majority Population (Traditionaly made of Greek Cypriots, Maronites, Armenians, etc) of the Northern Coast's area now Occupied by Ankara's Army since the 1974 Military Invasion, since it has notoriously pushed a Systematic Mass Influx, inside Cyprus' Occupied Territories, by many Settlers from mainland Turkey., while also Hindering Greek Cypriot Refugees to Return...

+ Meanwhile, the main Responsibility for the Implementation of ECHR's Judgements lies mainly at CoE's Top Political body, its Committee of Ministers, and raises Issues of Political Importance too, President Raimondi added earlier.


=> - "However, ECHR canNot Forget that Fundamental Dimension of the (PanEuropean Human Rights) Treaty's Article 46, which declares the Binding character of ECHR's Judgements", he also pointed out.


- "So, that's a Principle on which Nobody could make Concessions", ECHR President stressed.


- In consequence, "If there might be any Difficulties", for a State to implement ECHR's Judgements, "then, ECHR Hopes that they would be Temporary, and that they will be Settled", President Raimondi Urged,


underlying anew the fact that the above mentioned "Article 46 sets a Principle of Fundamental Importance".


+ He might also usefuly add Article 1 of that same PanEuropean Convention on Human Rights, according to which, all CoE's Member States undertake the Obligation to "Secure to everyone within their Jurisdiction the Rights and Freedoms defined" by it.


If adequately Combined with CoE Parliamentary Assembly's recent trend to hold National Delegations  of MEPs  Accountable of the Policies practiced by the Governments that they support, (as "Eurofora" had already suggested during last Year's ECHR's Press Conference (1/2015).

    EU-educated charming young Chinese presence started to be felt in Council of Europe's corridors in Strasbourg at the aftermath of an Historic Resolution adopted by its Parliamentary Assembly in favor of opening the possibility to give China a special "Status" in the PanEuropean Organization.

    - "My proposal to offer to China an official status as "Observer", in short term, under conditions, was welcomed" by the CoE : "The road to Dialogue between China and the CoE has now been opened", declared after Strasbourg's debates and votes the Head of France's delegation, MEP Jean-Claude Mignon.

    "Neither complacency, nor a mere condamnation of China", but a "wise approach of a political issue of great importance", advised Mignon to all those who'd either overload claims on Democracy, Human Rights or Minorities, or close their eyes to anything, there as elsewhere... A balance which was not exactly followed during debates, contrary to Mignon's personal stance, which appeared rather even-handed.

    China is the only UNO Security Council permanent member which has not yet any status at the CoE, being still obliged to be represented in Strasbourg by a General Consul : USA and Canada, even Japan and .. Mexico, have already got a special Status at the CoE, following Strasbourg's decision, back in 1995, to counter-balance the accession of Russia (1996) by creating special links to traditional "Western-world" allies.

    All former "Socialist" Eastern European countries started to have relations whith the CoE through its former sector on Culture and Education, before becoming full Members of Strasbourg's paneuropean organization. Speculations were unfolding recently about establishing a probable concrete link with China through the topical issue of anti-doping in Sport, on the occasion of the 2008 Olympic games.

    More spectacular, a meeting co-organized a few years ago in Strasbourg, by EuroFora and the International Space University between EU Parliament's long-time Rapporteur for EU's Satellite Navigation system "GALILEO", German MEP Brigitte Langenhagen, and a group of postgraduate students, attracted special interest from Chinese experts, and was followed, in less than a month, by the anouncement of China's intention to support EU's GALILEO project with a participation of 200 million €.

    Compared to that, revendications of .. "Turkish" Minorities, by Turkish MEPs, this week in Strasbourg, spreading through a wide area extended ...from Greece up to China, appeared less worrying, than pittoresque...

    Meanwhile, France's political will to start involving China and other important countries in European and Global affairs was due to be raised also at the forthcoming G-8 Summit in Japan by President Nicolas SARKOZY, (NDLR  : confirmed on July 5)
