EPP Party Head Daul to EuroFora on Ukraine: Keep Talks+Pressure, but Stop Killing !

*Strasbourg/EU Parliament/Angelo Marcopolo/- While efforts to urgently transform a dangerous end of Ceasefire Time Deadline expiring ToNight, into a long-term Truce for Peace Negotiations in Ukraine, were still going on, the experienced President of the Biggest EU Political Party : that of ChristianDemocrats/EPP, French MEP from Strasbourg, Joseph Daul, speaking to "EuroFora", stressed that, now, "Killings must Stop !", particularly of Civilians, at the Eastern areas of the Country.
- Even if EU "Pressure should continue to be exerced", f.ex. by keeping Sanctions ready, etc. etc, while, in parallel, EU should develop a real" Energy Policy", in order to ensure its independence and security of supplies, nevertheless, EU "Talks with Russia", must also continue, Daul added, remaining faithful to his earlier call for EU Leaders to "Speak with (Vladimir) Putin", as he had recently urged in reply to an "EuroFora"s question, (See :http://www.eurofora.net/newsflashes/news/daulonukraineandrussia.html), and was apparently heard by both the German and French Heads of State/Government, particularly Chancellor Angie Merkel, but also French President Francois Hollande, who notoriously multiplied lately their contacts, even on a Daily basis, with the Russian President, as well as the new Ukranian President Petro Poroshenko.
- However, concerning the use of Armed Violence, "certainly, this must Stop !", sharply replied Daul to "EuroFora"s question on the current Risk to re-start massive Deadly Military Attacks, killing also Civilians at the Eastern Regions of Ukraine, once the current Ceasefire's approaching Time Deadline will have expired soon...
A crystal-clear Call, by the experienced Top EU Politician, (initially Elected on November 2013 by EPP's Political Committee in Brussels, and recently re-Elected by the full EPP Congress at Dublin, on March 2014, by Thousands of participants, including National Parties and/or Heads of State/Government, MEPs, etc), which cannot be ignored, (added also to those earlier launched inside the CoE, by the latest EU Summit, even UNO's Secretary General Ban Ki Moon, etc. : See :http://www.eurofora.net/newsflashes/news/internationalcallsfortruceandpeacetalksinukraine.html ), particularly when it comes from the current Head of the Biggest EU Political Party (EPP), where belong Most Heads of State/Government among the 27 EU Member States, as well as the New EU Commission's President-designate, former long-time Prime Minister of Luxembourg and €uroGroup's Head, Jean-Claude Juncker, that the latest EU Brussels' Summit of Heads of State/Government has just confirmed as Official Candidate for the Top post of New EU Commission's President during the next 5 Years : 2014 - 2019, and is due to be endorsed also by the New EU Parliament, issued from the latest, May 2014 EU Elections, during its 2nd Plenary Session, later this Month in Strasbourg. Earlier Today, following also more than 2 Hours of Phone Talks yesterday, on Sunday, German Chancellor Merkel, together with French President Hollande, and Russian President Putin, as wall as new Ukranian President Poroshenko, reportedly spoke anew between them, just a few Hours before the expiration of the 10 Days-long Ceasefire (that both sides accuse eachother to disrespect it partly, to the point that even Civilian casualties didn't stop at the Dissident Regions), aiming to broker "an Agreement on a Mutual Ceasefire" between the 2 sides at the Dissident areas of Eastern Ukraine, as Merkel's Spokesman, Siebert, anounced Today.
But, given apparently also of the fact that, as they have already anounced since a long time ahgo, the Dissidents ask from Kiev's Military to withdraw its Army from their often bombarded Territories of Donetsk - Luhansk, in order to accept to sign a full and long-term Ceasefire, something that Kiev's authorities haven't yet accepted, while also demands to "Close" even the only 3 remaining Free Border crossing points, between Ukraine and Russia, seem to meet problems, as Dissidents are reportedly afraid that Kiev's Army doesn't even let pass badly needed Medical Supplies. Therefore, President Putin offered for Ukranian Customs Officers and OSCE Monitors to install themselves and check every pass at all the checkpoints from the Russian side of the Border, according to German Chancellor Merkel's Spokesman Siebert.
However, according to sources from the French President Hollande, efforts were still continuing to try to ensure a real bilateral Ceasefire agreement, and Dissident areas Donetsk-Luhansk's self-declared "People's Republic" (not-recognized) Borodai, reportedly said that a Tripartite meeting with OSCE's Envoy, Swiss Diplomat Heidi Taglavini, had been scheduled for next Morning, July 1st, while Ukranian President Poroshenko's office anounced that a "Security Council" Collective meeting was going on overnight. Initially due to anounce a Decision just before the Expiration of the unilateral Ceasefire Time Deadline, Tonight (Monday, 30 June 2014) at 10 p.m., nevertheless, the Kiev's SC hadn't yet anounced anything of the sort, even Hours later...

Meanwhile, the longest-serving MEP of all, former President of EU Parliament, German ChristianDemocrat MEP. Hans-Gert Poettering, in a moving "message" before he retires, (while remaining, nevertheless, President of the prestigious "Adenauer" Foundation, as well as Chairman of EU History's Museum in Brussels), reminded the tragic fact that, "I never saw my Father, who died in the 2nd WW, before I was born". Thus, even if "there are Challenges" recently, nevertheless, "don't accept, never, never", to destroy "our European Values", he urged all present, outgoing and incoming, old and new MEPs : - "Dignity of Human Being, Human Rights, Freedom, and Solidarity which unites us". The biggest achievement of the EU, is that we solve our problems, despite differences, among us. Don't let never destroy "Peace and Liberty" of "a United and Peaceful Europe", Poettering topically concluded.

ECHR's President to "EuroFora" on Journalists Gongadze and Adali murders : Principles must apply to all States, without discrimination.
+ ECHR's Statistics on Freedom of Expression (See below).
European Court of Human Rights' President, Jean-Paul Costa, questioned by "EuroFora" on Journalists' murders, as in Gongadze and Adali's cases etc., strongly stressed all CoE Member States' obligation to make efficient Investigations to find and punish those responsible, and underlined that ECHR's case-law's principles must apply to all without any discrimination.
His call was clearly supported by various Top MEPs who denounced a risk of "Double Standards" if some Journalists' murders are investigated, while others don't.
To avoid such risks, CoE's Parliamentary Assembly adopted a Resolution, on the occasion of Ukranian Journalist Gongadze's murder, "stressing", as a matter of general Principle, "the importance it attaches to the safety of Journalists and political activists, especially those linked to opposition groups, in ALL member states of the CoE". All "crimes against journalists and political activists must be investigated ... as a matter of priority, without political interference".
Costa was replying to "EuroFora"s question on the fact that, after CoE's Committee of Ministers, also CoE's Assembly had just adopted a Resolution on Gongadze murder case, based on an ECHR's judgement of 2005, asking a full Investigation from Ukraine, who has found and condemned in 10 years of jail 2 executants, but not yet the instigators.
While nothing similar was yet done for dissident Turkish Cypriot Kutlu Adali's murder, with 5 bullets shot at his head out of his Family's home in the territories of Cyprus occupied by Ankara's army, despite another ECHR's judgement of the same year 2005, and despite Turkey's claim that nobody was found among those responsible for the murder, and that there was nothing more to do..
In order to be credible and efficient, CoE's mechanisms shouldn't find a way to at least ask for full investigations of all Journalists' murders anywhere they might be committed, without exceptions ?

- "On the larger question that you raised, I'd like to say, since we are in a period of stock-taking on ECHR's 50 Years, that the Court's case-law developed certain concepts ....such as the Positive obligations of States, part of which are also the procedural obligations", started to reply ECHR's President.
- "Whenever Journalists, Lawyers, Defenders of Human Rights, or even simple Citizens are murdered, the States are held responsible, not only if its their own security forces' agents who committed these murders, but also if they didn't make sufficiently substantial and efficient Investigations", he stressed.
- "I want to strongly underline that we (ECHR) have found in many cases numerous violations of Articles 2 and 3 against States, ....(about) murders or torture, ...because they didn't make enough Investigations in order to try to find and punish those responsible".
- "We (ECHR) do that vis-a-vis all 47 (CoE) Member States, without any discrimination".
"Naturally, the circumstances in each particular case may be differend, and we can't ommit to apply the rules of proof, or the rules of criminal procedure".
"But we try, by all means, to apply these principles of our case-law, to all States", he concluded.

Costa's call was strongly supported by several Top CoE MEPs, from various Political areas
- "To investigate the murder of one Journalist, and not of another, looks like Double Standards", denounced the President of EuroLeft Group in CoE's Assembly, Dutch MEP Tiny Cox.
- "What is the reason ? Politics or specificity of a case ? Of course, if Cyprus and Turkey are involved, it's always a Political case"..
- "Murders of Journalists should always be fully investigated, because killing Journalists is not only killing persons, but also killing Free Press". "We (CoE's Assembly) should do our outmost to help People who are working on Free Press and they are under threat or murdered".
Because for Free Politics, Free Press is a pre-requisitive : Parliamentarians cannot function without a Free Press. Not investigating, is not protecting ourselves".
So we should investigate all Journalists' murders : We are talking about Gongadze, about the Cypriot man (Adali), about the Journalist murdered in Moscow one week ago, etc", Cox concluded
- "CoE can' look at these cases differently. CoE can't wear Blinckers !".
- "If the one is investigated, so has to be also the other. Why there wasn't full investigation ? Why's that ?", wondered British Socialist MEP, Alan Meale.
- "A good idea" would be to "make a Motion for Resolution", and "join all Journalists' murders. Adali and Gongadze etc", said to "EuroFora" EU Parliament Political affairs Committee's President, Goran Lindbland, ChristianDemocrat MEP from Sweden.

ECHR's Statistics on Freedom of Expression :
Almost Half of condemnations by ECHR for violations of Freedom of Expression in 2008, concern Turkey : 20 out of a total of 48 for all CoE's Member States.
Russia, Poland, France and Moldova were condemned only 3 times. Romania, Greece, Portugal, 2 times, and the other CoE Member States only 1 time, or none.

During the last Decade : 1998 - 2008, Turkey was condemned for violating Freedom of Expression in ..169 cases, while Austria only in 24.
France and Moldova in 14 and 13, respectively, closely followed by Russia and Poland with 11 and 10, respectively. The rest of CoE Member States had less than ten condemnations.
