EU Parliament boosts New Libya during Sarkozy + Cameron popular visit in Benghazi + Tripoli

Strong EU Parliament's Resolutions boosted New Libya and pointed at the need to find a way to protect the Syrian People, while, at the same time, French President Nicolas Sarkozy, together with UK Prime Minister David Cameron, were making a triomphal Popular surprise visit in Tripoli and Begnhazi, stressing the Principle of Help due to any Arab a.o. People peacefully struggling for Freedom ad Democracy, as well as that those who committed grave Human Rights' Violations will no more exploit total Impunity :

    - " The Gaddafi regime has come to an end and an interim Government led by the National Transitional Council (NTC) is about to begin working on building a new Libya", "whereas the EU has a vital interest in a democratic, stable, prosperous, peaceful North Africa", stressed from the outset EU Pariiament's Resolution on Libya.


    + MEPs "Express.. full support for the National Transitional Council (NTC) in its challenging task of building up a new state representing all Libyans; welcome the recent recognitions of the NTC and calls on all EU Member States and on the international community to follow suit; welcome the fact that all UN Security Council permanent members, including most recently China, have recognised the NTC as the legitimate authority in Libya; urge all African Union countries to recognise the NTC".


    EU Parliament "Welcomes the commitment made by the States and international organisations present at the ‘Friends of Libya’ summit held in Paris on 1 September 2011 to immediately release USD 15 billion in frozen Libyan assets, as well as the EU decision to lift sanctions on 28 Libyan entities, including ports, oil firms and banks; calls on EU Member States to seek UNSC authorisation and release still frozen Libyan assets to help the NTC deliver the governance needed in this transitional period and calls on Member States in particular to comply with the promises made at the Paris Conference".


    + It " Emphasises that the Libyan people started the revolution and led the way forward; takes the view that the future of Libya must rest firmly in the hands of the Libyan people, ensuring the full sovereignty of Libya"

On Gaddafi :


    - 'The International Criminal Court (ICC) issued on 27 June 2011 the arrest warrant for Muammar Gaddafi, his son Saif Al-Islam Gaddafi and his former intelligence chief Abdullah Al-Senussi for alleged crimes against humanity committed since the beginning of the popular rebellion", Resolution notes.


    => EU Parliament "Stresses that there can be no impunity for crimes against humanity and that Muammar Gaddafi and members of his regime must be held responsible and put to trial for their crimes under the rule of law". Thus, it "Urges all countries, especially Libya's neighbours, to cooperate with the new Libyan authorities and the international justice authorities, namely the ICC, to ensure that Gaddafi and his inner circle are brought to justice; recalls that, for instance, Niger and Burkina Faso are parties to the ICC and, therefore, have an obligation to cooperate with the Court and transfer Gaddafi and his indicted relatives to the ICC if they enter their territories; deplores the offer of asylum by Guinea Bissau to Gaddafi to go and live in that country, warning that this would be inconsistent with Guinea Bissau’s obligations under the Cotonou Agreement"'.

=> In conclusion, MEPs "Stress the importance of the successful outcome of the Libyan conflict for the region and in the context of the Arab Spring", and "urge other leaders in the region to draw lessons from Libya and to take heed of the growing popular movements calling for their rights and freedoms to be respected"

    + That's why, a  2nd Resolution on Syria, "Strongly condemns the escalating use of force against peaceful protesters and the brutal and systematic persecution of pro-democracy activists, human rights defenders and journalists; expresses its deepest concern at the gravity of the human rights violations perpetrated by the Syrian authorities, including mass arrests, extrajudicial killings, arbitrary detention, disappearances and torture"'

    _"Expresses its sincere condolences to the families of the victims and its solidarity with the Syrian people fighting for their rights, commends their courage and determination and strongly supports their aspirations to achieve full respect of the rule of law, human rights and fundamental freedoms and the guarantee of better economic and social conditions;

    + And "Supports the (EU) Council’s conclusions of 18 July 2011, which state that the Syrian regime is calling its legitimacy into question by choosing a path of repression instead of fulfilling its own promises on broad reforms"


    => In consquence, EU Parliament calls on President Bashar al Assad and his regime to relinquish power immediately, and rejects impunity"'

    Because, as a matter of general Principle, " this goes also for all Young Arab People in the World who want Freedom from their Chains :  - "France and Europe will stand by them ! That's a Message for 21th Century, It's the History's meaning which goes towards Peace and Union", Sarkozy promissed, speaking in a surprise visit welcomed in Tripoli.

    In Reply to a question on Libya's links with France and the UK in Future, as during the Liberation clash,  Libyan TNC President Abdel Jalil stressed that : "the Libyan People will Never Forget the Date of 19 March (2011) "We appreciate the position of France and the UK and this will be prolonged also after the War"


    "Even if, "until now, not any new agreement wasn't concluded, and we still respect all agreements concluded in the Past.


    "But we want Libya's full Development, and, even if we have Money, France and the UK have the Know-how". Therefore, "our Friends in France and in the UK will have the 1st Role to play (primodial), each according to its specialization (specific competences). "

    + Sarkozy made it clear that "no secret deal was ever brokered about Libya's riches. We did help because we believed that this was the Right thing to do (Justice)  and because the World doesn't need a Clash between the East and the West"


    "The Best gift that New Libya can do to us is to behave according to the Rule of Law, (f.ex., when there are contracts to conclude, to follow the normal legal procedure for Public procurement s...(appel d offres)", he added.


    "Some Documents that were published, are False, and part of a Manipulation. The Arab Public Opinions must know that the NTC led a Just Struggle, and the (International) Coalition helpêd it because it was Just (the Right thing to do).


    Libyan President Abdel Jalil confirmed that there was No Secret Deal ever concluded, and that the International Coalition's help was done mainly on a Humanitarian ground.  As a faithful Muslim People  We expressed our Gratitude for that Help^, and we are going, naturaly, to review any Deals which might have been concluded (in the Past) by Corruption, and/or when some Prices  are Exagerated in such kind of deals", he said.


    "As for the International Coalition's Help, it' wil be concluded when Libya wil be entirely Liberated, when all the Libyan Territories will be free and safe", NTC's President concluded. .

    Meanwhile, "All that Gaddafi has to do is give up Arms and present himself at a competent Court (i.e. to be judged)" stressed the British Prime Minister Cameron.   

 
    Replying to another Journalist's question on an eventual fugue of colonel Gaddafi and/or his cronies in some African Countries, such as Nigeria, f.ex.; New Libyan PM Abdel Jalil revealed that they spôke about that with both Sarkozy and Cameron, and NTC decided to sent from tomorrow a Delegation to Nigeria on that issue.


    Sarkozy replied that Nigeria's president was democratically elected and that we don't have any reason to suspect that he might not Respect the International Law.


=> "In the 21st Century, all Dictators in the World must know that there wil no more exist any area in the whole World where they might ensure their Impunity : Impunity is over !", Sarkozy warned in conclusion.

Meanwhile, in a spectacular Popular welcome at Freedom Square in  Benghazi; Sarkozy saluted the "Young Benghazi, Young Libyans, Young Arabs, we salute you with Friendship.  ....We wish a United, not a Divided Libya. France the UK and Europe will always stand by the Libyan People", he promissed.

They voted to "freeze" UK Government's draft to put People in jail for 42 Days on "anti-terrorist" suspicion without charge, or they abstained. Don't they look suspect ?

CoE's debate on UK controversy stirs PanEuropean check of anti-terror suspects' imprisonment

Former Leftists of the Sixties would boil in hot water if they heard PACE's debate on the controversial 42 days detention without charge, currently drafted by the British Government :

A "Socialist" Government, a Socialist PACE Rapporteur and a Socialist Chair of PACE's Legal Committee, opposed a .. "Conservative" amendment (supported by .. Liberals, Democrats, etc), to freeze the measure, in order to protect Citizens' Freedom, by "waiting" until CoE's Venice Committee checks its conformity with Human Rights' principles.

"Left"'s support to Conservative-Lib.Dem's criticism, wasn't enough to obtain a majority, nor to make things as they were back in the good old days, when "Left" and "Right" had a clear meaning, as "liberty" and "restrictions"...

Conservatives and most Democrats were joined by the Left in voting for the "freeze", as well as Liberal Paul Rowen, while Socialist MEP Ivan Popescu, an experienced MEP from Ukraine (PACE Member since 1996-2008) abstained. But most Socialists, added to a few Liberals and EPP's Right, voted against.

Fortunately, someone inside PACE had the wise idea to shorten the Debate for less than 1 Hour, and put it on the Agenda only at the end of an exceptionally busy day, towards the end of the Evening, when most MEPs had already gone to taste wins and foods at various Receptions all around Strasbourg's "European" area : As a result, not even 42 MEPs weren't present..

Socialist Lord Tomlinson accused the leaders of the PanEuropean Assembly, in its highest body : the "Bureau", to "lack wisdom" by deciding to hold a Debate on an issue that neither the Socialist Chair of the Legal Committee, nor its Socialist "reluctant Rapporteur", did "not want to do", ...

Finally, everybody (critics and supporters alike) was happy to agree, in substance, that the controversial measure "may" gravely violate Human Rights, and therefore, PACE asked Legal Experts of Venice Commission to check UK Government''s plans.

But this might take more than .. 42 Days to do, since PACE's Rapporteur asked the Experts to enlarge their study in a PanEuropean comparison of all that is happening on "anti-terrorism" legislation in 47 CoE Member Countries, including Russia, Turkey and Azerbaidjan..

Bad lack : "The existing 28 days’ detention without charge in the UK is, in comparison with other CoE member countries, one of the most extreme : In Turkey, the period is 7,5 days, in France 6 days, in Russia 5 days, and in .. the U.S. and Canada just 2 and 1 days respectively", denounced Democrat MEP Ms WOLDSETH from Norway..

"Numerous respected human rights organisations, including Liberty and Human Rights Watch, have expressed serious concern" "The proposed legislation ...could easily lead to extensive abuses. ...Detention for 42 days means six weeks in which one is taken away from one’s family, friends, home and livelihood only to be let off without being charged. That will destroy lives and isolate communities", she added.

- "3 years ago, the UK Government sought to increase the period of pre-charge detention from 14 days to 90 days. Not long before that, it had been only 7 days. There was a vigorous debate ...and a ...compromise was reached of 28 days. We have to ask whether there are proper safeguards in place to extend the period to 42 days. "Comments made ...by Norwegian delegates are unfortunate", replied British Socialist MEP Ms.Curtis-Thomas, accusing them to "besmirch the reputation of our police force, which is one of the Best in the World", as she said, believing that "there are significant safeguards ...to ensure that individuals are not subjected to unlawful detention"

PACE "has serious doubts whether ...the draft legislation are in conformity with the ...case-law of the European Court of Human Rights. A lack of ..safeguards may lead to arbitrariness, resulting in breaches of ... liberty and ...right to a fair trial". PACE "is particularly concerned that: ..the judge ..may not be in a position to examine whether there exist reasonable grounds for suspecting that the arrested person has committed an offence;"; that "... representation by a lawyer may be inappropriately restricted or delayed;" that "information on the grounds for suspicion of a person ...may be unduly withheld.. ;" that this "may give rise to arrests without the intention to charge;", and; in general, that "prolonged detention without proper information on the grounds for arrest may constitute inhuman treatment", says Klaus De Vries' Report, adopted with 29 votes against zero.

Records don't say if it took him 42 Days to draft his Report, but, at least, he knew why...
