EU Parliament President Tajani to EF: Cooperate with CoE on Web Journalist Daphne Murder Enquiry ?!
*Strasbourg/EU Parliament/Angelo Marcopolo/- Replying to an "Eurofora"s Question, EU Parliament's new President, the experienced former EU Commissioner and f. Minister, Antonio Tajani, from Italy, anounced his Readiness to eventually Cooperate with CoE's PanEuropean Organisation on Human Rights, Democracy and Rule of Law, in the Investigation of the recent Brutal Murder of Journalist Daphne Caruana Galizia in Malta, who was Killed by the Explosion of a Bomb in her car, apparently for the Strong Criticism that she used to exert on some Top Political Figures in her Country, as well as several Anti-Corruption Enquiries, that she Published in her Web "Notebook" at the Internet frequently, (See: http://www.eurofora.net/newsflashes/news/webjournalistmurder.html).

"Eurofora" had asked EU Parliament's President, during this November 2017 Plenary Session in Strasbourg, whether he would consider Cooperating with the CoE (which is also located, and even Headquartered in Strasbourg), in order to ensure an Efficient Enquiry on Daphne's Murder, about which, both her Family and various Other Observers, had already raised several Question Marks.

- Tajani considered Possible an eventual Cooperation between EU Parliament and the CoE for that purpose : - "May be", was his First Positive Reaction to "Eurofora"s relevant Question.
- "We shall see", EU Parliament's President added carefully, but promising to seriously consider that point.
- At any case, "We (EU Parliament) are Ready to Cooperate with Everybody" in order to elucidate that brutal murder, President Tajani clearlly offered.
- And he told us that he "knew" that EU Commission's President, Jean-Claude Juncker, had drafted a landmark Report in the Past for the Cooperation between the EU and CoE, (See Infra).
- He was speaking to "Eurofora" about that "International Investigation" that he found "Necessary", as he stressed earlier.
- Because "We (EU) want (at least) to Know the Name of the Killer", he previously pointed out.
+ "This is not against any Government in Malta etc", Tajani explained beforehand, Speaking to Journalists in Strasbourg, including "Eurofora".
=> - "It's simpy because We (EU Parliament) want to Protect Press Freedom, and the work of All Journalists", the President of the 28 Member States-strong Parliament underlined, as a matter of Principle.
>>> Significantly, he Replied to the above-mentioned "Eurofora"s Question on the sidelines of a Press Conference for the Official Inauguration of EU Parliament's reNovated Press Briefing Room in Strasbourg, Named, Today, after the brutally Murdered Maltese Journalist Brutally Murdered for her Critical Web News Publications at the Internet : "Salle Daphne Caruana-Galizia", (See relevant "Eurofora" Photo).
The Move (made also with the support of "Reporters without Borders" NGO for Press Freedom) follows a Tradition initiated, in the Past, with Brussels' Building for MEPs and EU Parliament's Secretariat, whose Press Briefing Room has been Named "Anna Politkovskaya", (with the support of the "International Federation of Journalists", after the Murdered Russian Journalist who was reportedly covering mainly the Chechen Issue before being Killed. Many Suspects have been reportedly Arrested, since then, and 6 finaly Condemned in Prison, but the initial Instigator allegedly seems to have not been found yet.

- The relevant Fact that EU Commission's President, Jean-Claude Juncker, had written, in the Past, an landmark Report on the "Cooperation between the EU and the CoE", after an Official Demand made by CoE's 47 Heads of State/Government, at a PanEuropean Summit in Warsaw, Poland, on 2005, (Comp. "Eurofora" co-Founder's NewsReports from Warsaw, then, published at "TCWeekly"), and presented a few Years Later in a Press Conference at the CoE in Strasbourg (See "Eurofora"s Newsreport, with Juncker's Replies to our Questions, at : ...), was apparently known to Tajani as he told us, (Comp. Supra).
+ Previously, Concluding an Exceptional Debate among Political Parties' Leaders at EU Parliament on Daphne's brutal Murder, during the 2nd Plenary Session of October 2017, EU Commission's 1st Vice-President, Frans Timmermans, had already evoked a "Cooperation with the Maltese Authorities, and OTHER BODIES that Could be Implicated in the Investigation".
- As for "this (EU) Commission, (it) will leave no stone unturned in that area to make sure that this Atrocious, Barbarous Assassination does Not lead to the conclusion which is clearly wanted by those who perpetrated it : namely that we doN’t Dare ask Questions or we don’t dare Investigate. This will Not happen. This is a Promise I make on behalf of the (EU) Commission", he had concluded.
=> - " The effect of such a public display of Barbarism – which this assassination was – the intended effect, of course, is to Intimidate, to make sure that no investigation is carried out any more, that nothing is pursued, that others will be Self-Censoring their own investigation. I think this is the biggest Challenge we face: that we are Not intimidated by what was done; that we as Europeans collectively accept the responsibility in the EU to make sure that we are not intimidated; that institutions can function independently; that perpetrators are brought to justice; that if this is linked to organised crime or to corruption, that this is pursued", Timmermans had said.

Meanwhile, COE's Secretary General, Thornbjorn Jagland, from Norway, and CoE Assembly's President, Stella Kyriakides, from Cyprus, were among those who Published a clear Condamnation of Daphne's brutal Murder, urging for an Investigation to Find and Punish those responsible for that Crime, according to ECHR's case-law.
In addition to the ECHR, CoE has also a PanEuropean Commissioner for Human Rights ; a special Mechanism for Dealing with various serious Attacks against Journalists, in Cooperation with several Press Freedom NGOs ; an Assembly composed by MEPs present also in the National Parliament of each Member Country, and exposed to eventual Sanctions in case of various wrongdoings ; a Committee of Ministers responsible for Monitoring the Implementation of ECHR's Judgements by Member States ; Many specific Resolutions, Recommendations, Conventions, Decisions, comprehensive Studies, Legal Experts, and various other Texts specifically on Press Freedom and Protection of Journalists, on which the Organisation has a Long Experience, (etc).

ECHR's President to "EuroFora" on Journalists Gongadze and Adali murders : Principles must apply to all States, without discrimination.
+ ECHR's Statistics on Freedom of Expression (See below).
European Court of Human Rights' President, Jean-Paul Costa, questioned by "EuroFora" on Journalists' murders, as in Gongadze and Adali's cases etc., strongly stressed all CoE Member States' obligation to make efficient Investigations to find and punish those responsible, and underlined that ECHR's case-law's principles must apply to all without any discrimination.
His call was clearly supported by various Top MEPs who denounced a risk of "Double Standards" if some Journalists' murders are investigated, while others don't.
To avoid such risks, CoE's Parliamentary Assembly adopted a Resolution, on the occasion of Ukranian Journalist Gongadze's murder, "stressing", as a matter of general Principle, "the importance it attaches to the safety of Journalists and political activists, especially those linked to opposition groups, in ALL member states of the CoE". All "crimes against journalists and political activists must be investigated ... as a matter of priority, without political interference".
Costa was replying to "EuroFora"s question on the fact that, after CoE's Committee of Ministers, also CoE's Assembly had just adopted a Resolution on Gongadze murder case, based on an ECHR's judgement of 2005, asking a full Investigation from Ukraine, who has found and condemned in 10 years of jail 2 executants, but not yet the instigators.
While nothing similar was yet done for dissident Turkish Cypriot Kutlu Adali's murder, with 5 bullets shot at his head out of his Family's home in the territories of Cyprus occupied by Ankara's army, despite another ECHR's judgement of the same year 2005, and despite Turkey's claim that nobody was found among those responsible for the murder, and that there was nothing more to do..
In order to be credible and efficient, CoE's mechanisms shouldn't find a way to at least ask for full investigations of all Journalists' murders anywhere they might be committed, without exceptions ?
- "On the larger question that you raised, I'd like to say, since we are in a period of stock-taking on ECHR's 50 Years, that the Court's case-law developed certain concepts ....such as the Positive obligations of States, part of which are also the procedural obligations", started to reply ECHR's President.
- "Whenever Journalists, Lawyers, Defenders of Human Rights, or even simple Citizens are murdered, the States are held responsible, not only if its their own security forces' agents who committed these murders, but also if they didn't make sufficiently substantial and efficient Investigations", he stressed.
- "I want to strongly underline that we (ECHR) have found in many cases numerous violations of Articles 2 and 3 against States, ....(about) murders or torture, ...because they didn't make enough Investigations in order to try to find and punish those responsible".
- "We (ECHR) do that vis-a-vis all 47 (CoE) Member States, without any discrimination".
"Naturally, the circumstances in each particular case may be differend, and we can't ommit to apply the rules of proof, or the rules of criminal procedure".
"But we try, by all means, to apply these principles of our case-law, to all States", he concluded.
Costa's call was strongly supported by several Top CoE MEPs, from various Political areas
- "To investigate the murder of one Journalist, and not of another, looks like Double Standards", denounced the President of EuroLeft Group in CoE's Assembly, Dutch MEP Tiny Cox.
- "What is the reason ? Politics or specificity of a case ? Of course, if Cyprus and Turkey are involved, it's always a Political case"..
- "Murders of Journalists should always be fully investigated, because killing Journalists is not only killing persons, but also killing Free Press". "We (CoE's Assembly) should do our outmost to help People who are working on Free Press and they are under threat or murdered".
Because for Free Politics, Free Press is a pre-requisitive : Parliamentarians cannot function without a Free Press. Not investigating, is not protecting ourselves".
So we should investigate all Journalists' murders : We are talking about Gongadze, about the Cypriot man (Adali), about the Journalist murdered in Moscow one week ago, etc", Cox concluded
- "CoE can' look at these cases differently. CoE can't wear Blinckers !".
- "If the one is investigated, so has to be also the other. Why there wasn't full investigation ? Why's that ?", wondered British Socialist MEP, Alan Meale.
- "A good idea" would be to "make a Motion for Resolution", and "join all Journalists' murders. Adali and Gongadze etc", said to "EuroFora" EU Parliament Political affairs Committee's President, Goran Lindbland, ChristianDemocrat MEP from Sweden.

ECHR's Statistics on Freedom of Expression :
Almost Half of condemnations by ECHR for violations of Freedom of Expression in 2008, concern Turkey : 20 out of a total of 48 for all CoE's Member States.
Russia, Poland, France and Moldova were condemned only 3 times. Romania, Greece, Portugal, 2 times, and the other CoE Member States only 1 time, or none.

During the last Decade : 1998 - 2008, Turkey was condemned for violating Freedom of Expression in ..169 cases, while Austria only in 24.
France and Moldova in 14 and 13, respectively, closely followed by Russia and Poland with 11 and 10, respectively. The rest of CoE Member States had less than ten condemnations.
