*Strasbourg/Angelo Marcopolo/- Surprizingly, After the Recent Press Interviews by "Eurofora" with Mathew Caruana Galizia, Daphne's Son and Journalist himself, and European "ARTE" TV Film-Maker on Daphne's Murder, (New Film due to be Finalized and Published on 2/2020), German Journalist Tim Röhn, at the Beginning of November (4 and 8) on the occasion of CoE's Annual 2019 "World Forum for Democracy", (See : ... + ..., etc), subsequent Developments concerning Daphne's Murder Investigation suddenly appeared to, at last, Start Evolving in the Direction that we had Discussed then :

- "Eurofora" had raised a Question, to Both, on Why there was, until Then, a so Blatantly big Difference between Investigations on Web Journalists' Murders first in Malta, (where Not any Instigator had yet been found at all, and Nobody Bothered among several Suspect Politicians), compared to Slovakia, later-on, (where Instigators were cought and various Top Politicians a.o. had been Seriously Affected) ?

That Key Question, in Fact, (even if Not Explicitly Raised yet), had Already Occupied EU Parliament's Committee on Legal Affairs and Liberties, at the Eve of May 2019 EU Elections, when Dutch Liberal MEP Sophie in't Veld was Preparing her relevant Report on that exceptional serial of Journalists' Murders on 2017, withOut recent precedent in Europe.

- Even if they Replied at Different Moments, (Despite having Initially Heard our Question at the Same Moment and in the Same Circumstances), Both Andrew and Tim proved to be quasi-Unanimous on the Main Diagnosis :

>>> It's Because in Slovakia, corrupted and/or inefficient Politicians and/or their Cronies had been Obliged (by popular Protests, Public Pressure, and/or Factual Revelations) to Resign, while, on the Contrary, in Malta, something Similar had Not Happened yet, at least until that moment, they Both Replied in substance, Mathiew at First.

+ Tim advanced a Step Further, Adding, Later-on, also that, in Slovakia's case, (that he Knew well, since the Victim had been, in fact, Working for the Same Big German Media Company as himself), it's Even those in charge of the Investigation (such as Justice Minister, Attorney General, Police Director, etc) who had been Affected too, and, in most cases, Changed and Replaced by Other Persons, more Willing to Act accordingly.

 

- As for "Journalists' Safety", at least as things stand until Today, "you can Ask ME !...", Bitterly smiling told "Eurofora" Daphne's 2nd Son, Mathew, a Journalist himself, speaking right in Front of CoE's "Platform to Promote the Protection of Journalism" Stand inside the PanEuropean Organisation's HQ Building, on the occasion of its Annual "World Forum for Democracy 2019"....

=> Nowadays Latest Developments on Daphne's Murder in Malta, clearly appear to unfold, precisely, According to that Pattern :

- At First, probably Because of a Time Deadline fixed by the CoE, 2 Years After the 2017 Car Bomb Explosion, added to an "InterPol" Involvement from Nearby Lyon HQ, as well as an Exceptionally Joint, strong Statement by UNO's, OSCE's and CoE's Top Watchdogs for Press Freedom, (who clearly Pleaded for Daphne's "Public Interest" Service, as they Named it, Web Journalism : See http://www.eurofora.net/newsflashes/news/coeosceunondaphnemurder.html), etc, notoriously, some Interesting "New Facts" were Revealed, More key Arrests made, and at least 2 Politicians Resigned, (including the Head of Prime Minister's Office), Opening Hopes that, at last, All the Truth would be Found, and all Instigators UnMasked and Punished for that Brutal Murder.

That was, roughly, the Situation, just 1 or 2 Weeks After "Eurofora"s above-Mentioned INTWs with Mathew Caruana Galizia and Tim Röhn in Strasbourg, (Comp. Supra), i.e. around the 19th of November 2019.

* But, Since then, all out of a Sudden, a kind of Negative "U-Turn" seems to have, More Recently, Bursted out, Threatening to Block, in fact, the still on-going and UnFinished Investigation, or, rather, to Oblige it to Deviate, Pushing it Away from any Top Political Instigators, by Risking to Restrict it Only in a Few Intermediaries, isolated Individuals from the Private Sector, in a way practically Anodynous for any Corrupted Establishment !

Even More than this Trend in itself, it's the Facts about the apparently very Arbitrary Decisions and other Measures Taken, which looks really Revolting... Among many and various others, at least :

- The above-mentioned Head of the Maltese Prime Minister's Office, Mr. Schembri, was Only Briefly Heard by the Police, and Immediately Released, 100% Free.  

- An arrested Intermediary, a Private Businessman, Jorgen Fenech, who had Offered to give Testimony on Who was the Instigator for Daphne's Murder, in exchange of Amnesty for himself, reportedly Targetting Schembri and some Ministers around Prime Minister Joseph Muscat, was Refused Amnesty, after 6 Hours of Deliberation by the Government, headed by Muscat. Vainly, Fenech's Lawyers had Warned the Judges that Muscat should Not Influence that Decision, because he had an interest to Refuse.

- Prime Minister Muscat, who had initially said that he would Resign too, Now announced that he Wants to Stay in Office until Mid-January 2020, to supervise the Investigation...

- Moreover, PM. Muscat even Closes the Parliament until the End of January 2020, (i.e. does as ...Cromwell in Great Britain, and even Better than current Conservative Prime Minister Boris Johnson, who Tried, but Couldn't Close Down an Hostile Parliament, not even for some Days !).

- Fenech's Lawyers, who had Warned the Judges that the current Head of the Investigations' team should be Changed, Because he was too much Influenced by Schembri and/or PM. Muscat, are Ignored.

- On the Contrary, Muscat's Government gives an Amnesty to anOther Intermediary : Taxi-Driver Melvyn Theuma, who, Initially had Designated as Instigators Both Schembri and Fenech, but, Later-on Focuses Exclusively against Businessman Fenech alone !

- However, Daphne's WebNews Site practically ...Ignores Businessman Yorgen Fenech, that she does Not Cite But Only One (1) sole Time, inside a very Short Article, just 2 Days Before her Death... (On the Contrary, during Many Years, she strongly Criticizes and Denounces Prime Minister Muscat and several among his Ministers, - particularly Konrad Mizzi, initially in charge of Health, afterwards Energy, and Now Tourism, who Resigned-, and, particularly, the Head of Prime Minister's Office, Schembri, that she calls a "Crook", and pictures even at the Last Publication of her Life, just Before she's Brutaly Murdered : The Famous Article with the Mention : - "There are Crooks Everywhere you look now. The situation is Desperate.")...

- So that, Since Prime Minister Muscat seems to Deal Personally with the Investigation (Comp. Supra), almost Any Top Political Lead has been practically Droped. On the Contrary, it's a Low-Level, Not Politically Motivated Hypothesis, which is exclusively Privileged, Limited into a shady, obscure Private Businessman alone, (that Daphne Ignored, most of the time : Comp. Supra) !

Suddenly, you don't hear anything not even about Minister Konrad Mizzi, (resigned), who was a notorious target of Daphne's Criticism, very Close to PM. Muscat and Schembri, while People start to Forget (as the Establishment's Medias curiously Ommit to Mention now), that, initially, he was Minister of Health, before taking over Energy and afterwards Tourism, in charge of a Huge Project to give 3 Public Hospitals of Malta to a Foreign Private Company, whose Owners still Remain "UnKnown", as the Murdered Journalist's Youngest Son, Paul, told recently "Eurofora", but apparently Linked at least to an USA Researcher Focused on Genetic Manipulations, who has recently Reached a Phase for "Tests" on his Controversial and UnCertain Methods, and, Perhaps, even related to the Scandal of "Medical Visas", to which was notoriously linked Muscat's Office former long-time Agent, Neville Gafa, who recently (2018-2019) surfaced anew in the "News" for some Strange, UnExplained Visits and even Political Meetings in Libya, (at the Small Area still controlled by a Shaky Government limited around Tripoli), among Press Speculations in Various Kinds of "Smuggling", from Medical Visas to Irregular Migrants, Fuel, even Brutal Islamist Armed Gangs' Chiefs, etc., and, is, Nowadays, Often Visiting Schembri in his private House, for UnKnown reasons, as CoE's Rapporteur on Daphne's Murder, Dutch MEP Peter Omtzigt just observed, (etc)...

>>> However, many Concrete Facts, including Recent Revelations, clearly Point towards several UnDeniable, even Direct Links between Daphne's Murderers or Intermediaries and Prime Minister Muscat's Office !

Among various others, See, f.ex., also the following :

- Earlier, even that Intermediary Taxi Driver, Melvyn Theuma, related to the Killers, (Comp. Supra), had Noted on Paper that the Instigators of Daphne's Murder were not only Fenech, but Also Prime Minister Muscat's Office Director, Schembri.

- Theuma (who was given Amnesty for his Testimonies : Comp. Supra) had even been Invited to Personaly Visit the Prime Minister's Office, soon After the Latest, 2017 Elections, (i.e. Near the Date of Daphne's Murder), and he did visit that, then.  

- On this occasion, he reportedly even Met Personaly Schembri, took a "Selfie" Photo Together with him, and was Shown Prime Minister Muscat's own Bureau, (etc).

- Moreover, the Intermediary Theuma was also Told, then, that he had just been Enrolled as Agent in a Public Service, and even Started to be Paid the First Months' Salaries, (withOut Yet Knowing Where he was Supposed to be Working)...                                                         

- In Addition, a Public Security Agent, (Later Identified as Keneth Camilleri, a Long-Time Security Guard at Prime Minister Muscat's Office, even Following him in several Official Visits, Abroad, but also Neville Gafa in Libya, later-on), as well as a certain "Johann", have reportedly promised Theuma that the Killers would be, Later, "granted Bail, and receive €1 Million each", as many Medias and CoE's Rapporteur noted.

+ Meanwhile, in Parallel, even the Other Intermediary, Businessman Fenech, "has since Testified that Schembri (Prime Minister Office's Director) had kept him Constantly Informed about the Investigation", and  "Telephone Data is said to show Frequent Contacts between Fenech and Schembri prior to Fenech’s Arrest". Moreover, Schembri "Warned him that his Phone was Tapped, Conspired with him to Evade Arrest, and passed Secret Messages to him (even) After his Arrest, Telling him What to Say to the Police", observed CoE's Rapporteur on Daphne's Murder, Dutch MEP Peter Omtzigt, in his Latest Written Note, Dated 6 December 2019, and released from Strasbourg.


++ Even Prime Minister Muscat himself, "Admitted that he continued to exchange text Messages with Fenech, after he became Prime Minister", and  "Continued" also After Fenech "became an Suspect. Apparently, this was done with the Knowledge of the Malta Security Service (MSS)", Despite the fact that "Muscat had Previously Denied any Contact with Fenech for a ‘Year or two’ before his arrest", CoE's above-mentioned Text adds.


+++ Just this Sunday, 8 Dec. 2019, PM. Muscat's Office former Chief of Staff, Schembri, was reportedly Taken again by Police for anOther Questioning about Documents, (including a Official ID Pass, "Selfie" Photo, and HandWritten Note, etc), around Middleman Theuma's Facticious "Job" to a Public Sector entity, depending from the "Family Ministry", which was, then, Managed by Michael Farrugia, the Current Minister in charge of the Police !...

 

++++ And Fenech's Lawyers have Already Denounced that Chief Investigator, Inspector Keith Arnoud, was regularly Informing Schembri about the Progres of the Enquiry on Daphne's Murder, asking to Replace him : The Issue has just Started to be Examined by the Courts, which Postponed for After Mid-December...


+++++ But, don't Worry : In Addition, P.M. Muscat's and Schembri's own Lawyer's Daughter-in-Law, Nadine Lia, is reportedly the Magistrate overseing the Enquiry on that Middleman Theuma's Fake Government Job gift, (as the Murdered WebJournalist's Family just Denounced : UPDATED) !!!...


=> Thus, in Malta's "Labour" Party, Nowadays, it seems that all its "Best" Elements and Pals, are, by a Coincidence, taking due "Care of the Investigation" on Daphne's Brutal Murder...

 

 So that the currently Growing Popular Demonstrations, Activists' Protests, (including at controversial Prime Minister Muscat's Office), etc., seem Natural and Inevitable, as things stand.

>>> In such Circumstances, it's Obviously Easy to understand why EU Parliament's Delegation of MEPs which has just Visited Malta, Returned back with a Message Warning about an imminent "Risk" against "the Integrity of the Investigation", particularly, as long as "Prime Minister Muscat is (still) in place" !

=> That's why, also CoE's Rapporter on Daphne's Murder, Peter Omtzigt, "strongly reiterate(d) (his) Call for Prime Minister Muscat to Resign with Immediate effect. There must be a Prompt and Effective Investigation of the allegations that members of his Office were Implicated in the Murder and its Cover-up. By clinging to office, Muscat Risks Undermining the Investigation and doing yet further Damage to Malta’s national institutions and international Reputation", he Warned in a Written Statement published in Strasbourg on 6/12/2019, (and, meanwhile, even "New Facts" surfaced, during this Week-End, to Further Justify that : Comp. Supra).

Developments clearly show that the 2nd Point made by ARTE's Film-Maker on Daphne's Murder, just after Meeting also his Son Mathew, Earlier in Strasbourg, in the Replies that they both gave to the above-mentioned "Eurofora"s Question about the Causes of that Astonishig Differene between Malta and Slovakia on Web-Journalists' successive Murders since 2017, (Comp. Supra), is, in Fact, the Most Decisive Issue on 2019 : I.e. Urgently Change those who Monitor the Investigation !

 

Indeed, "the next 40 Days will be Crucial" for Daphne's Murder Enquiry, Warned EU Parliament's competent Delegation of MEPs, as also CoE's Rapporteur reminded this Week-End.

People in Europe and the World expect from CoE to make a succes of its "Monitoring" for Human Rights and Democracy, despite difficulties, said Finland's President Tarja Halonen to "EuroFora" at a crucial moment for the mecanism built 15 years ago by the paneuropean organization which celebrates its 60th Anniversary in 2009.

Halonen, known as "Mother" of CoE's "Monitoring" mecanism, a long-time MEP and former Foreign Minister before becoming Finland's President, holds a long experience in the mattter, after also serving twice as CoE and EU Chairwoman in the past. That's why she is well placed to judge how CoE's "monitoring" should deal today with some crucial issues of importance both to CoE and to the EU.

The move came just a Month before a crucial, last visit to Turkey, scheduled for June, by the President of CoE''s "Monitoring" Committee, Ukranian MEP Serge Holovaty, to finalize his Report on Ankara, the CoE Member State with the longest Monitoring procedure. From its results depends its overall credibility.

This is a Test-case, because, in fact, it's in order to avoid Sanctions threatened against Turkey by a CoE's Assembly's April 1995 Resolution for grave Human Rights violations, Democracy gaps, the continuing Military Occupation in Cyprus, the unresolved Kurdish problem, Aegean differend with Greece, etc., that MEPs decided to create, for the 1st time on April 1996, a "Monitoring" proces, allegedly destinated to check, without excluding Countries who did not fulfill all CoE's standards.

In the Past, the obliged withdrawal of Greece's Military regime and of its "Civil" cover-up out of the CoE had helped bring back Democracy in 1974. But, on the contrary, since April 1996, the idea was to "monitor" Human Rights' respect while keeping most concerned Countries inside the CoE. After Turkey's oldest example, this was extended also to several former "Eastern" European Countries, even if CoE's Assembly has imposed to some of them (fex. Ukraine, Russia, etc., after Belarus, Serbia, etc) various "Sanctions", that Ankara always avoided. Curiously more succesful even than .. USA itself, (a CoE "Observer" since 1995), which has been at least threatened with sanctions some years ago..

EU-effects of CoE's Monitoring process became obvious between 2001-2008, since the "closure" of this procedure, when CoE felt that a Country had met most of its Human Rights, Democracy and Rule of Law obligations, (i.e. the "Copenhagen Criteria" for the EU), helped trigger Negotiations with the EU for "Accession" or other closer relations : This occured already before the 2004 and 2007 EU Enlargements to former "Eastern" European Countries, as well as for the commencement of "accession" negotiations with Croatia, and of "open-ended" negotiations with Turkey in 2005.

    But a stricking new development are Holovaty's recent findings that on core Human Rights issues as Torture and Freedom of Expression, Turkey, even "5 Years after" CoE closed its "Monitoring", back in 2004, inciting EU to start accession Negotiations in 2005, still presents grave problems.

    His findings are of crucial importance after a 2008 CoE Resolution called, "if need be", to "seriously consider the possibility of Re-Opening the Monitoring procedure for Turkey" : A move which might affect Ankara's controversial EU bid, since EU Accession Negotiations are based on the Hypothesis that the Candidate fullfils the "Copenhagen Criteria" (See above)..

    Holovaty expressed his will to check  "Matters still Outstanding" and  those that he "didn't have an opportunity to discuss" at an earlier visit this year, "in order to discuss the more complex issues in greater depth", at his forthcoming New Visit to Ankara, before the December 2009 EU Summit.  This is all based on the 2004 CoE Resolution which stresses that, CoE "will continue.. post-monitoring Dialogue with the Turkish authorities,...in addition to a 12-points list,..and on any Other Matter that might arise in connection with Turkey’s Obligations as a CoE member state".

    CoE's Resolution also asks  from Turkey "to secure the proper Implementation of Judgements, particularly in the Cyprus v. Turkey InterState case", of 2001, which concerns also the plight of many Hundreds of MISSING People. It adds Turkey's obligations to "execute" ECHR's Judgements in the Loizidou case,..and in particular adopt General Measures to avoid repetition or continuation of Violations found by the Court" to the detriment of Refugees.

    Nevertheless, Holovaty said to "EuroFora" that "MISSING" persons,"might be included" and cannot be excluded, but he has yet to examine the situation "to find out  which issues will be raised" to the Turkish Government.

    Therefore, "EuroFora" asked Halonen, as the Historic "Mother" of CoE's Monitoring mecanism, if she thought that, "whenever there are grave Human Rights Violations, as fex. "MISSING" persons, attested even by ECHR's judgements, they should be always checked by a Monitoring process. Or could they be forgotten ?"
    
     - "We (CoE) must be, at the same time, Fair, Realistic, but not in the mind that "now we have Forgotten", etc., replied to "EuroFora"'s question Halonen, speaking as a matter of general principle.

    - "When we think of those People that are suffering from the lack of Democracy, of Human Rights, and of the Rule of Law", "we should find a base on how to deal with the (Monitoring) system more rapidly"', she stressed.

    - "Sometimes it's very difficult to combine Transparency and Effectivenes together, particularly in this specific case", she went on to say. But, "I have not found a (CoE Member) Country who could be insensitive in this sens", Halonen answered concerning grave Human Rights violations attested by the ECHR.

    - "I have no ready-made answer. I have the expectations that you, in the CoE, will, step by step, find the different types of the monitoring systems."

    Also "because this is a part of the UN's Post-Conflict system, (fex. when it comes to Cyprus' MISSING persons), and it's a more Global system". So that, "If we make a succes in Europe, the others will follow", throughout the World.  "But they expect that we (Europe) are this opportunity, this Opportunity to make a Succes", Halonen concluded.

    In addition, she advised to extend CoE's Monitoring to all its 47 Member States, "because, as long as we hear that, all these monitoring systems are "OK for the neighbor, but not for me", "it's very difficult" to understand. Something which could make easier to Compare...

    Finnish MEP Jaako Laakso, former CoE Rapporteur on the Occupied Territories of Cyprus and one of the 5 Signatories of the Historic CoE's call to create the "MONITORING" mecanism since 1996, was more specific :  - "We (CoE Assembly) have to find a way for the issue of Cyprus' MISSING People to be better followed", he stressed, anouncing his intention to "speak to Mr. Holovaty" about that. "There might be also other ways", added Laakso.

    - The 2008 "Year had been a very Bad one for Turkey with regard to Human Rights in general, and Freedom of Expression in particular", denounced, meanwhile, Holovaty's preliminary Post-Monitoringh Draft Report by Holovaty, published by the CoE on April 2009.

    "Amnesty International believes that freedom of expression is not guaranteed given the various articles of the Criminal Code that restrict it. .. "For example, 1,300 Websites are said to have been closed down by the (Turkish) authorities in 2008" ! While "the new Turkish Criminal Code was used to bring a total of 1,072 proceedings between June 2005 and April 2008, and led to the conviction of 192 people", for expressing views. "Representatives of the Özgür Gündem newspaper, which specialises in Kurdish affairs, ..complained about Numerous Attacks on their Freedom of Expression ...as was everyone who advocated a settlement to the question by means other than the intervention of the army" "According to their figures, 19 Newspapers had been suspended 43 times between 4 August 2006 and 4 November 2008" !...

    Moreover, on 2008,  CoE's "Ministers adopted its 4rth Resolution on the execution of the judgments of the ECHR, ...and outstanding issues regarding 175 Judgements and decisions relating to Turkey delivered between 1996 and 2008...  concerning Deaths resulting from the excessive use of force by members of the Security forces, the failure to protect the right to life, the DIisappearance and/or death of individuals, Ill-Treatment and the Destruction of property". CoE's " Ministers urged the Turkish authorities ...to ensure that members of Security forces of all ranks can be prosecuted without administrative
authorisation" for "serious crimes". Holovaty reminded.

"Nonetheless", Holovaty heard anew of "Several cases of Violence committed last year (2008) by the (Turkish) security forces". Amnesty International speaks of Many Cases of ill-treatment and Torture in the prisons and by the police". "Including, fex."'the death of Engin Ceber, a young man of 29 who died on October 2008 as a result of the TORTURE allegedly inflicted on him by police officers, prison staff and members of the gendarmerie. He was part of a group of people arrested on September 2008 during a demonstration and Press Conference in Istanbul'. Proceedings against suspects are "on-going" in this case.

- " I therefore noted an Obvious Contradiction between the Government’s stated “zero tolerance” policy.... of Torture and other forms of ill-treatment, and the different testimonies given", denounced CoE's Rapporteur.  Turkish "authorities must make considerable efforts to guarantee that proper investigations are carried out into allegations of abuses by members of the security forces and that perpetrators are effectively punished" "In this respect, I have requested detailed Statistics on the number of Investigations, acquittals and convictions in cases involving allegations of abuse in order to show the positive impact of the measures taken to date", Holovaty said, repeating a permanently unsatisfied CoE's demand to Turkey since a Decade...

    - "The Political Crisis that shook the country in the spring of 2008 highlighted the Weaknesses of the (Turkish) Constitution", which comes from the Military regime of 1982, "and the Urgent Need of Reforms", stressed from the outset CoE's Rapporteur in 2009. In particular, "the ...Democratic functioning of state institutions, including the independence of the judicial system, are crucial", he observes.

    But, "the Electoral  system and the ways in which it is circumvented do not appear to give those elected complete Legitimacy, and tend to pervert the course of direct universal suffrage", denounces Holovaty, observing that, even 5 Years later, Turkey did not yet change the 10% nationwide Threshold for a party to take any seat, which is "far higher" than the "3%" maximum in Europe and already condemned as contrary to European Standards by the CoE.

    + Moreover, EU Parliament's 2009 Report on Turkey, drafted by Dutch MEP Ria Oomen-Ruijten and adopted in Strasbourg on March, expresses "Concern over the Failure of the (Turkish) Judiciary to prosecute cases of Torture and Ill-treatment, the Number of which is Growing". EU also "is concerned about continuing Hostility and Violence against Minorities" in Turkey.
