*Strasbourg/CoE+EU Parliament/Angelo Marcopolo/- The 1st Official Visit to EU Parliament by New EU Health Commissioner designate, Stella Kyriakides, by a Timely Coincidence, this Same Week in Strasbourg that CoE hold here a Seminar to Boost Social Charter's Rights, an area where she has notoriously worked as an Expert for Decades in the Past, and includes important Health Issues, naturally Triggered many Interesting reactions by several Top CoE or EU Officers in charge of such activities, that some consider as a Key part of Human Rights, while Also being a very Topical matter in the Fight against Poverty and Discrimination/UnEquality, as well as for EU's much Needed Cohesion, as "Eurofora" found in the spontaneous Replies that they kindly gave to our relevant Questions, (See Infra).

Both Events had been placed, from the outset, at the Highest Level, since it's in order to Meet with the New President of EU Parliament, David Sassoli from Italy, that Kyriakides had come to Strasbourg, (a former President of CoE's Parliamentary Assembly herself, after Chairing its Social/Health affairs Committee, as MEP from Cyprus: Comp. f.ex. her Replies to "Eurofora" Questions in her quality as PACE President at http://www.eurofora.net/newsflashes/news/newpacepresidentkyriakidestoeurofora.html, etc), while the above-mentioned PanEuropean Seminar on CoE's Social Charter's boost was Organised by the French Presidency of the CoE (May - November 2019), and was opened by the experienced CoE's Deputy Secretary General Gabriella Battaini-Dragoni, also from Italy, together with the Chairman-in-office of CoE's Ministerial Committee (its Highest Political body), the French Ambassador/Permanent Representative Jean-Baptiste Mattei.

Stella Kyriakides had arrived to Strasbourg, at EU Parliament, with her Team already since Monday Evening, and met Sassoli on Tuesday, i.e., just 1,5 Day Before COE's Seminar on Social Rights starts on Thursday Morning.

- Speaking to "Eurofora" shortly afterwards, CoE's Chairman Mattei mainly pointed to the Fact that European Countries as France and Portugal, who are reportedly among the First to have Ratified All CoE's Social Rights' Charter's legal istruments, (including the New procedure of Monitoring also by Collective Applications, f.ex. of relevant International NGOs, etc.), should be Joined also by Other Countries ASAP, while Boosting CoE's "Torino Strategy", decided a few Years ago, and refurbished at the Latest, May 2019, CoE's Ministerial Summit in Helsinki, Finland, in Addition to Developing, in parallel, Nowadays, CoE-EU Cooperation.

+ From CoE's point of view, in this Seminar (prepared Together with Strasbourg University's "Carré de Malberg" Center of Research on Public Law, but also with the Participation of several relevant International NGOs, in addition to other independent Experts and Government Representatives), as Main Reasons to Act More Vigorously Now for elementary Social Rights, were given, in the Debates, particularly the recent Problem of an allegedly Growing "Poverty" and/or "InEquality", aggravated by a Socio-Political Exploitation from so-called "Populist" Movements (sometimes Hostile to EU Integration) Nowadays.

coes_social_rights_seminar_eurofora_400

++ From EU's point of view, it was Added, particularly, a wish to Develop Europe's "Social Pillar" (particularly since 2017, i.e., in the Middle of Juncker's EU Commission, a Great Political Figure of Center-Right's ChristianDemocrats/EPP, notorious also for his relevant Appeal :  - "Don't Abandon Social Policy to Socialists !"), as the recent Economic Crisis had Aggravated pockets of Poverty and/or Rising InEquality, But, even More in order to Face a Growing Need for EU's "Cohesion" and Fight against some Gaping "Divergences" Between EU Member States.

- F.ex., speaking to "Eurofora", International Movement ATD-"Fourth World"'s (Father Joseph Wresinski's notorious creation) representative, Helene Rozet, who has reportedly Worked Both at Haiti and Egypt, But Also at Paris' Suburbs, etc., stressed that Poverty cases are, indeed, recently found inside Europe too, and Not Only around Some Migrants, but Even among several Authentic French People, of Long French Origin, (particularly Visible through some Severe "Housing" Problems, etc).

---------------

coe_src_president_palmisano_on_board_eurofora_400

=> Thus, incoming New EU Health Commissioner Elsa Kyriakides, "could certainly Help" elementary Social Rights of the People, f.ex., "by Speaking about the Europen Social Charter" (of the CoE), that she knows well, "and Urging Member States to fulfill their Commitments", soberly but substantially Replied to an "Eurofora" Question the President of CoE's PanEuropean Committee of Social Rights, (the Highest Body in this field), Giuseppe Palmisano.

---------------

eucommission_d.director_on_jobs_social_affairs_inclusion_delarue__agg_eurofora_400

+ As for EU Commission's deputy Director for Employment, Social Affairs and Inclusion, Rudi Delarue, from the Netherlands, speaking later to "Eurofora", he Stressed the "Fundamental" Importance that "Health" has inside EU's "Social Pillar", (f.ex. via Projects to support "Handicaped" People, the Plan against Cancer, "Access" to Social Protection", etc), while also reminding tha the incoming New EU Commission's President-elect, Ursula von der Leyen, has "Studied Medicine", (in Addition to her Husband's involvement in Bio-Medical Research), as well as the Fact that it was "partly Inspired by CoE's Social Charter", whose extensive Experience, by Stella Kyriakides (Comp. Supra) could certainly Help a very useful "Synergy".

eu_parliament_plenary_in_strasbourg_19.9.2019_eurofora_400

++ Apparently Converging towards a Similar Direction, the incoming New EU Commissioner-designate announced, while she was Visiting EU Parliament to meet with its New President Sassoli, Earlier this Week in Strasbourg, that "Mainstreaming Health across All EU Policy Areas (i.e. including for the Fight Against Poverty and/or Discrimination, but for Cohesion, etc) will be a shared Priority for the next 5 years" (2019-2024). once the New Commission is confirmed" by MEPs' forthcoming Votes.

---------------

coe_sociial_charter_director_malinowski__agg_eurofora_400

>>> Thus, in Consequence, the New Director of CoE's Social Charter, Jian Malinowski from Spain, (an experienced former Head of Medias section), speaking  later to "Eurofora", appeared quite Enthousiast when he Learned that a former Long-Time CoE's Expert on these Issues, like Kyriakides (Comp. Supra), was becoming New EU's Commissioner on Health, a Key Pillar of Social Rights, and Vowed to strive to Develop the Best possible EU-CoE Cooperation, on this occasion.

-----------------------

strasbourg_university_lccturer_schmitt_eurofora_400

However, one of the Current Problems, which Surfaced during this Seminar's Debates, was a kind of "Tension" between at least certain Member States' Governments (sometimes, even those among the More Advanced in Social Rights' Legal recognition)  and the way that CoE's Social Charter is Recently working in real Practice, as, among otherq, also Melanie Schmitt, a Strasbourg University Lecturer on Social Rights, particularly evoked, pleading for a Better overall Respect of Principles in this Sensitive area.

Already, Eliane Chemla, General Rapporteur of the PanEuropean Committee on Social Rights, (CoE's Watchdog for the Implementatio of its Social Charter), speaking at the Beginning of this seminar, had Advised recalcitrant States to Better see "Sanctions" (for alleged Violation of certain Social Rights), as a kind of "Preventive" Measures, serving to Alert in order to Avoid Risks of undue Human Sufferings, possible Social Upeavals and/or Political Expoitation of them, which could be a Real "Trouble"...

But, among others, particulary Stefan Clauwaert, Senior Legal and Human Rights' Advisor, at the European Trade Union ConFederation, in Brussels, unveiled Both a Jurist's Technical Knowledge and a kind of Fighting Spirit, which apparently moved some among the audience...

-------------------

coe_social_chartersecurity_governemenal_ctee_director_faber__agg_eurofora_400

Nevertheless, Joseph Faber, from Luxembourg, the President of CoE's Governemental Committee for the Social Charter and Social Security Code, speaking to "Eurofora", (after staying, apparently, Calm during that Controversy, withOut participating explicitly Now to that Public Debate), told us that, in his View, those Problems indeed felt recently by several Governments, are not so much due to CoE's Social Charter itself, (Neither to the New Monitoring Procedure via Collective Applications as such : Comp. Supra), But rather to the Concrete Use that the Current Committee on Social Rights is allegedly Making out of those Rules and/or Principles...

A Point which, Obviously, if it's sufficiently Confirmed, inter alia, might also Leave to the EU a quite Large Margin of Manoeuvre, in the Concrete Way that it could Make Good Use of CoE's Social Charter itself.

----------------

professor_quesada_at_coes_social_rights_seminar_eurofora_400_01

+ Moreover, HighLighting the Conclusions of this CoE's Seminar, the experienced Professor Luis Jimena Qesada, from Spain, former President of CoE's Social Rights' Committee (and, perhaps, also Future), added a Series of Wider Action possibiiities :

- First of all, even some National Governments, sometimes ...Ask for an eventual "Condemnation" by CoE's Social Charter's Watchdog, in order to Find a Legitimate Pretext to Make some Legislative Reforms for which they didn't yet have a clear Majority in their Parliament, he observed. And CoE's Social Charter Experts, Can also Contribute Efficiently into National Law-Making by Member States, f.ex. through adequate Meetings with COE's PanEuropean Parliamentary Assembly in Strasbourg, since its MEPs are, at the Same Time, Important National MPs, he pointed out. To all this Could be also added a kind of useful "Pedagogy", vis a vis Universities, National Parliaments, Judges, Lawyers, NGOs, etc., he went on to advise for the foreseable Future.

------------------------

Meanwhile, relevant Political Controversies, particularly around Poor or Impoverished People, but also Middle-Class Citizens' Access to Healh Care, have been, Recently, Sky-Rocketing in Public Debates, not only in Europe, (f.ex. in France, mainly in relation to irregular Foreign Migrants, etc), but even More in the USA, (Both during the Latest Presidential Elections, and even Since the Primaries, also Inside the Democratic Party, Nowadays). The Main thrust concerning Conditions and Modalities of Access, But anOther, Related Issue, being the recently Fast-Growing Costs, (USA having the Most Expensive Health System in the World), sometimes vaguely attributed to some unnamed "Technological Innovations", (which, Curiously, instead of Simplifying and making Health Care more Efficient, on the Contrary, Complicate and OverBurden it, sometimes uselessly, and/or in order to "Test" New Equipments), but apparently as a result of a Shady, Bureaucratic Mecanism controlled by - and feeding- Technocrats, (which, mutatis-mutandis, has been also Criticized in France, even by Mainstream, Experienced Politicians).

The incoming Swedish EU Presidency (July-December 2009) may still remain in favour of Turkey's controversial EU bid, despite June 2009 EU Elections' results, but it has "very strong demands on Turkey"'s obligation to respect EU Rules, said the Head of Swedish Foreign Ministry's Press Service, Cecilia Julin, to "EuroFora", reacting to critical Press reports.

    - "I know (that) the link is often made also to Sweden's position on Turkey"'s controversial EU bid. Indeed, "we (Swedish EU Presidency) are very much engaged in the future membership of Turkey, but not without fullfiling all the Criteria".

    - "It's very clear that we (Swedish EU Presidecny) have very Strong Demands on Turkey, in a sort of concept for Future membership of the Union, ...which will be a Long Process...", she stressed.

This means, in particular, "the Copenhagen Criteria (on Human Rights, Democracy and Rule of Law), and also the adaptation to the Acquis of the European Union".

     - "If you listen to what Mr. Bildt (the Swedish Foreign Minister) says on Turkey at different occasions, it's very clear : We want Turkey to become part of the Union, in the Future. But we want it to fullfil all the Criteria : The Acquis of the European Union. That's very clear", she concluded.

The Senior Official of the Swedish Foreign Ministry was reacting to critical Press Reports, from Brussels' Journalists invited by EU Commission's secretariat to Stockholm, who claimed that Bildt was abusing of a ..."Whip" (sic !) against Cyprus, by "threatening" the presence of UNO's Peace-keeping force at the "Green line" which separates the island's Government-controlled areas from the territories occupied by Ankara's army, if Nicosia didn't accept any political solution, regardless of Turkey's demands, before the end of 2009.

Governing AKEL Party's new Secretary General, Andros Kyprianou, reacted by declaring that no-one can threat the People of Cyprus : -"We shall decide for our Future, and nobody else",  he reportedly said, asking to "keep calm". "In order to find a Solution soon, certain basic Principles must be respected", he stressed, calling those who feel an urgency to use their influence on Turkey. Other Political Parties were more critical.

This was a reference to recently reported statements by Turkish Minister Bagis, Prime Minister Tayip Erdogan and Turkey's National Security Council (a Military-Political body), accused to push towards a partitionist "2 States" solution, contrary to UNO SC Resolutions for Cyprus' reunification.

December 2009 is a crucial moment for EU's appraisal of Turkey's controversial EU bid, because EU Council has decided to review then Ankara's compliance with the European position on the recognition of Cyprus' Government, which was clearly set out by an EU reply of 21 September 2005 to Turkish Prime Minister Tayip Erdogan's claims, refusing to recognize even the existence of EU Member Cyprus, in controversial statements he made to London (former EU chair) on July 29, 2005.

EU Parliament's latest Resolution on Turkey, adopted on March 2009 in Strasbourg, warned Ankara that "the non-fulfillment of Turkey's commitments... by December 2009, may further seriously affect the process of Negotiations" with the EU.

In practice, the issue boils down to Ankara's "embargo" against Ships and Airplanes using Cyprus' seaports or airports at the strategic EU island, which traditionaly hosts one of the World's biggest Shipping flags. EU has already "freezed" 6 relevant Chapters in EU - Turkey Negotiations since December 2006, after Ankara refused to fullfil a commitment it had undertaken when EU had decided to open controversial "accession" negotiations with Turkey, back on December 2005.

    - "As far as EU - Turkey relations are concerned, it's clear that Turkey needs to fullfil its obligation of full, non-discriminatory implementation of the additional Protocol (to "EC-Turkey Association Agreement"),  This is an important issue....and should be addresseed as soon as possible as it clearly affects the pace of the accession negotiations.Issues covered by the Declaration of September 2005 will continue to be followed up, and progress is urgently awaited", warned earlier in Strasbourg the out-going Czech EU Presidency (former vice-Prime Minister Alexander Vodra).

But the Head of the Swedish Foreign Ministry's Press Service, Cecilia Julin, dismissed "interpretations" by "some" that Foreign Minister Carl Bildt was reportedly "threatening" Cyprus with consequences on the UNFICYP, if it doesn't accept any solution until December 2009, while Turkey is reportedly delaying in an attempt to impose a partitionist "2 States" solution.

On the contrary, Julin, stressed that "Sweden has strong demands on Turkey'"s respect of "Copenhagen Criteria and EU Acquis".

Meanwhile, Sweden  is "concerned" about the risk of "Stalemate" in Cyprus' Talks, but is well aware that "the main responsibilities lie with the two leaders and the UNO", Europe playing only a role of "facilitator".

After carefully verifying, the Head of Swedish Foreign Ministry's Press Service, stressed to "EuroFora" that Bildt's reference to UNFICYP "was not linked to a Threat", and dismissed those who "interpreted" it so.

On the contrary, the Swedish EU Presidency acknowledged the fact that Peace Talks are mainly for the UN and the leaders of the Cypriot communities, EU's role being limited into that of a "facilitator".

As for Turkey's reported attempts to impose a "2 States' solution", the Head of the Swedish Foreign Ministry's Press Service sharply replied by stressing that Turkey must respect the "EU Acquis" rules.

    In particular :

    - "Basically he (Bildt) underlined that it's the leaders of the two communities in Cyprus and the UN that have the main responsibilities for solving the problem", started to say the Swedish Senior Official to "EuroFora", referring to the above-mentioned "briefing".

    - "But the EU had a role in sort of pointing out the benefits and facilitating a little bit the outcome for the settlement of the whole Cyprus' issue", she added.

    - "And he did state the Fact, that the rest of the World (i.e. USA, etc) will, of course, look at the differend issues which are at the table, and the future of the UN Peace keeping force is part of what is at the table", she admitted.

    - "I understand that some have interpreted that as a Threat, by the Swedish Minister" "But", in reality, "it's a statement of a Fact, that, when we'll look at the differend issues, one of the issues on which we shall have to take a stand on, is the future of the UN Peace keeping force in Cyprus".

Indeed, one of the questions usually raised for a Solution of Cyprus' issue is what International and/or European or other Guarantees, by a Peace-keeping force, might be needed afterwards, eventually for a transitory period.

Questioned anew by "EuroFora" whether (according to critical Press Reports) this could be taken as a veiled warning that, if Cyprus didn't accept any Turkish demand for any solution whatever, it might be left alone to face Ankara's Military Invasion/Occupation, she denied :

    - "He (Bildt) didn't say it in that way"... "It was not linked to a threat, or anything like that", the Head of the Swedish Foreign Ministry's Press Service stressed.

On the contrary, "he (Bildt) underlined that the main responsibility lies with the parties concerned on the island". "The EU can try to facilitate and show the benefits of reaching a settlement. But also, when the EU and the rest of the World (i.e. USA) will have to look at it, they will look at all the Facts on the table, and the presence of the UN Peace-keeping force is one".

And "he (Bildt) didn't speak about that at all", she replied to "EuroFora" question on Turkey's reported attemps to impose, in one way of another, a partitionist "2 States solution".

Asked whether Bildt's aim was to incite both parties to move forward efficiently, she agreed :

    - In fact, "the EU is really very concerned with the Stalemate in the situation. Yes !", the Head of Sweden's Foreign Ministry's Press Service anounced. That's why Bildt "was hoping for the two parties (i.e. for Turkey's also) to engage and break, a little-bit, the present stalemate, come to a solution of the issue" of Cyprus.

But, replying  to a "EuroFora"s question on the risk, denounced by several politicians in case of strict Time Deadlines, for Turkey to provoke a stalemate and wait for the time to come to impose a partitionist "2 States' solution", she reacted by pointing at Turkey's obligation to respect "EU Acquis" :

    - "Turkey must fullfil the EU Acquis : That's clear !", the Swedish Senior Official stressed.

More details are expected when Swedish Prime Minister Reinfeldt will debate his Programme with new MEPs at EU Parliament's plenary mid-July in Strasbourg, that he has visited already in 2008.

Foreign Minister Carl Bildt became familiar with Strasbourg's CoE last year, when Sweden chaired the PanEuropean organization of Human Rights. As EU chairman-in-office, he will also chair the 27-member States strong EU Group inside the 47-member States strong CoE.

Minister for EU affairs, Cecilia Malmstrom is well known at EU Parliament, where she has been an active MEP of the Liberal Group for many years, following also Press Freedom issues.

Both have already made various statements at "EuroFora", on differend topical matters.
