Finding a balance between freedom and security is an old story. Totalitarian and free countries do not have a common vision on this, except of course in cases of extreme necessity, such as major natural or other disasters, or even NBC.

Some nations, whose calculating leaders have lost faith, and perhaps the compass or even the professionalism that came out of the Cold War, are confining themselves.

There is, however, progress on the part of some heads of state, who are listening and changing their way of thinking, especially when full powers are put in place? However, these powers seem to me to be inadequate to the present health and health situation. Indeed, this is not a war, the subject matter is disproportionate, but a health situation that needs to be addressed in the societal, scientific, medical, laboratory and pharmaceutical fields.

As I pointed out privately at the outset of this case, the central questions are not being answered; Mrs Condoleezza Rice asked the right questions during the video conference at the Hoover Institute on 14 April 2020. Obviously we have seen some bounce back from this intervention.

This raises the question of diagnosis and evaluation.   

This being the case, there is no need to provoke other states like the Chinese in this matter, but to solve the problems in international cooperation.

 Europe has been slow to react, particularly because of the change of Commission last July, and the arrival of many young people inexperienced in European affairs, both in the European Council and the European Parliament. The renewal of the European political generation is a fact that must be taken into account.  

Although the 2019-2024 term of office is experiencing teething troubles, all the players in the European institutions now have a duty to acquire and build on their experience in order to progress.  This also involves a phase of humility in relation to the ambitions of a few. The problems are well known. First of all, I would recommend continuing the work of the Junker Commission and then progressing step by step towards selected and voted developments agreed by the Member States and the citizens.  

We will be able to rely on the experienced players in our institutions, both European civil servants, MEPs and Member States, to meet these challenges.

Finally, after a few months of virtual absence, some progress has been made in tackling the European public health problem: such as the establishment of common resources at different levels to solve the problem, taking into account the disparities between health systems and their approaches in the European states.  

This is a path that helps European progress, in cooperation with the MS that are doing their research, while extending at international level the effort needed to resolve this health crisis. Work together!


There is no need for any autocratic process or authoritarian power drift, whose objectives would not be very clear and would take us back to an earlier period around the 19th century.

Our institutions, nations and citizens are following the curve of progress in all fields, and the scales of value appreciation have evolved positively over the decades, the use of psychological or other techniques to return to the painful past we know is a professional fault on the part of those who use such methods. Let us remain vigilant in the face of these egocentric deviations.

I recall that Jesus Christ liberates and heals; it is also a dimension!  Keep faith and hope!

Freiheit, Gesundheit, Sicherheit,

Wege des Verstehens

Ein Gleichgewicht zwischen Freiheit und Sicherheit zu finden, ist eine alte Geschichte. Totalitäre und freie Länder haben diesbezüglich keine gemeinsame Vision, außer natürlich in Fällen äußerster Notwendigkeit, wie bei großen Natur- oder anderen Katastrophen oder sogar bei ABC-Katastrophen.

Einige Nationen, deren berechnende Führer den Glauben und vielleicht auch den Kompass oder sogar die Professionalität, die aus dem Kalten Krieg hervorgegangen sind, verloren haben, schränken sich ein.

Es gibt jedoch Fortschritte seitens einiger Staatsoberhäupter, die zuhören und ihre Denkweise ändern, vor allem, wenn volle Befugnisse eingeführt werden. Diese Befugnisse scheinen mir jedoch im Hinblick auf die gegenwärtige gesundheitliche und gesundheitliche Situation unzureichend zu sein. In der Tat handelt es sich hier nicht um einen Krieg, die Thematik ist unverhältnismäßig, sondern um eine Gesundheitssituation, die in den Bereichen Gesellschaft, Wissenschaft, Medizin, Labor und Pharmazie angegangen werden muss.

Wie ich zu Beginn dieses Falles privat darauf hingewiesen habe, dass die zentralen Fragen nicht beantwortet werden, hat Frau Condoleezza Rice während der Videokonferenz im Hoover-Institut am 14. April 2020 die richtigen Fragen gestellt. Offensichtlich haben wir gesehen, dass sich einige von dieser Intervention erholt haben..

Unter diesen Umständen ist es sinnlos, andere Staaten wie die Chinesen in dieser Angelegenheit zu provozieren, sondern die Probleme in der internationalen Zusammenarbeit zu lösen.

 Europa hat nur langsam reagiert, vor allem wegen des Wechsels der Kommission im vergangenen Juli 2019, und der Ankunft vieler junger Menschen, die in europäischen Angelegenheiten unerfahren sind, sowohl im Europäischen Rat als auch im Europäischen Parlament. Die Erneuerung der europäischen politischen Generation ist eine Tatsache, der man Rechnung tragen muss.  

Obwohl die Amtszeit 2019-2024 Kinderkrankheiten aufweist, haben alle Akteure in den europäischen Institutionen nun die Pflicht, ihre Erfahrungen zu sammeln und auszubauen, um voranzukommen.  Dazu gehört auch eine Phase der Demut gegenüber den Ambitionen einiger weniger. Die Probleme sind bekannt. Zunächst einmal würde ich empfehlen, die Arbeit der Junker-Kommission fortzusetzen und dann Schritt für Schritt auf ausgewählte und abgestimmte Entwicklungen zuzugehen, auf die sich die Mitgliedstaaten und die Bürgerinnen und Bürger geeinigt haben.  Wir werden uns bei der Bewältigung dieser Herausforderungen auf die erfahrenen Akteure in unseren Institutionen verlassen können, sowohl auf die europäischen Beamten, die Abgeordneten des Europäischen Parlaments als auch die Mitgliedstaaten.   

Schließlich sind nach einigen Monaten virtueller Abwesenheit einige Fortschritte bei der Bewältigung des Problems der öffentlichen Gesundheit in Europa erzielt worden: So wurden auf verschiedenen Ebenen gemeinsame Ressourcen zur Lösung des Problems geschaffen, wobei die Unterschiede zwischen den Gesundheitssystemen und ihren Ansätzen in den europäischen Staaten berücksichtigt wurden.  

Dies ist ein Weg, der den europäischen Fortschritt in Zusammenarbeit mit den MS, die ihre Forschung betreiben, fördert und gleichzeitig die zur Lösung dieser Gesundheitskrise erforderlichen Anstrengungen auf internationaler Ebene ausweitet.

Es besteht keine Notwendigkeit für einen autokratischen Prozess oder ein Abdriften autoritärer Macht, deren Ziele nicht sehr klar wären und uns in eine frühere Periode um das 19. Unsere Institutionen, Nationen und Bürger folgen der Kurve des Fortschritts in allen Bereichen, und die Skalen der Wertschätzung von Werten haben sich im Laufe der Jahrzehnte positiv entwickelt, der Einsatz psychologischer oder anderer Techniken zur Rückkehr in die Vergangenheit ist, wie wir wissen, ein professioneller Fehler derer, die solche Methoden anwenden. Lassen Sie uns angesichts dieser egozentrischen Abweichungen wachsam bleiben.

Ich erinnere daran, dass Jesus Christus befreit und heilt; es ist auch eine Dimension!

Libertà, salute, sicurezza,

modi di intendere

Trovare un equilibrio tra libertà e sicurezza è una vecchia storia. I paesi totalitari e liberi non hanno una visione comune su questo, tranne naturalmente in casi di estrema necessità, come ad esempio grandi catastrofi naturali o di altro tipo, o anche NBC.

Alcune nazioni i cui leader calcolatori hanno perso la fede, e forse la bussola o anche la professionalità emersa dalla guerra fredda, si stanno confinando.

C'è, tuttavia, un progresso da parte di alcuni capi di Stato, che ascoltano e cambiano il loro modo di pensare, soprattutto quando vengono messi in atto i pieni poteri? Tuttavia, questi poteri mi sembrano inadeguati all'attuale situazione sanitaria e di salute. In effetti, non si tratta di una guerra, l'argomento è sproporzionato, ma di una situazione sanitaria che deve essere affrontata in campo sociale, scientifico, medico, di laboratorio e farmaceutico.

Come ho fatto notare privatamente all'inizio di questo caso, le domande centrali non hanno avuto risposta, la signora Condoleezza Rice ha posto le domande giuste durante la videoconferenza all'Hoover Institute del 14 aprile 2020. Ovviamente abbiamo visto un po' di ripresa da questo intervento.

Ciò solleva la questione della diagnosi e della valutazione.   

Stando così le cose, è inutile provocare altri Stati, come i cinesi, ma risolvere i problemi della cooperazione internazionale.

 L'Europa ha reagito con lentezza, soprattutto a causa del cambio di Commissione dello scorso luglio 2019 e dell'arrivo di molti giovani inesperti negli affari europei, sia al Consiglio europeo che al Parlamento europeo. Il rinnovamento della generazione politica europea è un fatto di cui bisogna tenere conto.  

Anche se il mandato 2019-2024 sta attraversando un periodo di difficoltà iniziali, tutti gli attori delle istituzioni europee hanno ora il dovere di acquisire e valorizzare la loro esperienza per progredire.  Ciò comporta anche una fase di umiltà in relazione alle ambizioni di pochi. I problemi sono ben noti. Prima di tutto, raccomando di continuare il lavoro della Commissione Junker e poi di procedere passo dopo passo verso sviluppi selezionati e votati concordati dagli Stati membri e dai cittadini.  Per affrontare queste sfide potremo contare sull'esperienza degli attori delle nostre istituzioni, sia dei funzionari pubblici europei, sia dei deputati al Parlamento europeo e degli Stati membri.   

Infine, dopo alcuni mesi di assenza virtuale, sono stati fatti alcuni progressi nell'affrontare il problema della sanità pubblica europea: come la creazione di risorse comuni a diversi livelli per risolvere il problema, tenendo conto delle disparità tra i sistemi sanitari e dei loro approcci negli Stati europei.  

Questo è un percorso che aiuta il progresso europeo, in collaborazione con gli SM che stanno facendo la loro ricerca, estendendo a livello internazionale lo sforzo necessario per risolvere questa crisi sanitaria.

Non c'è bisogno di alcun processo autocratico o di una deriva di potere autoritario, i cui obiettivi non sarebbero molto chiari e ci riporterebbero a un periodo precedente, intorno al XIX secolo.

Le nostre istituzioni, le nazioni e i cittadini stanno seguendo la curva del progresso in tutti i campi, e le scale di apprezzamento dei valori si sono evolute positivamente nel corso dei decenni, l'uso di tecniche psicologiche o di altro tipo per tornare al passato che sappiamo essere una colpa professionale da parte di chi usa tali metodi. Rimaniamo vigili di fronte a queste deviazioni egocentriche.

Ricordo che Gesù Cristo libera e guarisce; è anche una dimensione!

chemins de compréhension

Trouver un équilibre entre liberté et sécurité, vieille affaire. Les pays totalitaires et les pays libres n'ont pas de vision commune à ce propos, sauf évidemment en cas d'extrême nécessité, style catastrophe majeure naturelle ou autre, voire NBC.

Certaines nations dont les responsables calculateurs ont perdu la foi, et peut être la boussole voire le professionnalisme issu de la guerre froide, confinent.

Il y a cependant des progrès de la part de certains chefs d'état, qui sont à l’écoute et évoluent dans leurs façon de penser, en particulier lorsque les pleins pouvoirs sont mis en place, cependant, inadéquats à cette présente situation sanitaire et de santé. En effet il ne s'agit pas d'une guerre, le propos est disproportionné, mais d'une situation sanitaire à régler dans les domaines sociétaux, scientifiques, médicaux, laborantins, et pharmaceutiques.

Comme je l’ai signalé dès le départ de cette affa, ire, les questions centrales ne sont pas répondues, Madame Condoleezza Rice a posé les bonnes questions au cours de la visioconférence à l’Institut Hoover le 14 avril 2020. Évidemment on a vu rebondir certains suite à cette intervention.

Cela pose la question du diagnostic et de l’évaluation  

Ceci étant il est inutile de provoquer d'autres états comme les chinois en la matière, mais de résoudre les problèmes en coopération international.

 L'Europe a mis du temps à réagir, du fait notamment du changement de Commission en juillet dernier, et de l'arrivée de nombreux jeunes inexpérimentés en la matière européenne, aussi bien au Conseil Européen et au Parlement Européen. le renouvellement de la génération politique européenne est un fait dont il faut tenir compte.  

Bien que la mandature 2019-2024 connaisse des ratés au démarrage, l'ensemble des acteurs des institutions européennes, ont maintenant le devoir d'acquérir et de bâtir leur expérience pour progresser.  Cela passe aussi par une phase d'humilité par rapport aux ambitions de quelques-uns. Les problèmes sont connus. Dans un premier temps, je préconise la continuité des travaux de la Commission Junker puis de progresser pas à pas vers des évolutions choisies, et votées, agrées par les EM et les citoyens.  

L'on pourra s'appuyer sur les acteurs expérimentés de nos institutions, aussi bien les fonctionnaires européens que les eurodéputés et les Etats membres pour répondre à ces enjeux.   

L'on note enfin, après quelques mois de quasi absence, quelques progrès face à la problématique de santé publique européenne: comme la mise en place de ressources communes de différents niveaux, pour résoudre le problème en tenant compte des disparités entre les systèmes de santé et leur approches dans les états européens.  

C'est un chemin qui aide au progrès européen , en coopération avec les EM qui font leur recherches, et en prolongeant au niveau international l'effort nécessaire à résoudre cette crise sanitaire.

Il n'est nul besoin de quelque procédé autocratique ou de dérive de pouvoir autoritaire, dont les objectifs ne seraient pas très clairs  et ramèneraient à une période antérieure vers le XIX siècle. Nos institutions , nations et citoyens suivent la courbe du progrès tous domaines, et les échelles d'appréciations des valeurs ont évolué de manière positive avec les décennies, l’emploi de techniques psychologiques ou autres pour revenir au passé que l'on connait est une faute professionnelle de la part de ceux qui utilisent de telles méthodes. Restons vigilants face à ces déviation égocentriques

Je rappelle que Jésus Christ libère et guérit; c'est aussi une dimension!

People in Europe and the World expect from CoE to make a succes of its "Monitoring" for Human Rights and Democracy, despite difficulties, said Finland's President Tarja Halonen to "EuroFora" at a crucial moment for the mecanism built 15 years ago by the paneuropean organization which celebrates its 60th Anniversary in 2009.

Halonen, known as "Mother" of CoE's "Monitoring" mecanism, a long-time MEP and former Foreign Minister before becoming Finland's President, holds a long experience in the mattter, after also serving twice as CoE and EU Chairwoman in the past. That's why she is well placed to judge how CoE's "monitoring" should deal today with some crucial issues of importance both to CoE and to the EU.

The move came just a Month before a crucial, last visit to Turkey, scheduled for June, by the President of CoE''s "Monitoring" Committee, Ukranian MEP Serge Holovaty, to finalize his Report on Ankara, the CoE Member State with the longest Monitoring procedure. From its results depends its overall credibility.

This is a Test-case, because, in fact, it's in order to avoid Sanctions threatened against Turkey by a CoE's Assembly's April 1995 Resolution for grave Human Rights violations, Democracy gaps, the continuing Military Occupation in Cyprus, the unresolved Kurdish problem, Aegean differend with Greece, etc., that MEPs decided to create, for the 1st time on April 1996, a "Monitoring" proces, allegedly destinated to check, without excluding Countries who did not fulfill all CoE's standards.

In the Past, the obliged withdrawal of Greece's Military regime and of its "Civil" cover-up out of the CoE had helped bring back Democracy in 1974. But, on the contrary, since April 1996, the idea was to "monitor" Human Rights' respect while keeping most concerned Countries inside the CoE. After Turkey's oldest example, this was extended also to several former "Eastern" European Countries, even if CoE's Assembly has imposed to some of them (fex. Ukraine, Russia, etc., after Belarus, Serbia, etc) various "Sanctions", that Ankara always avoided. Curiously more succesful even than .. USA itself, (a CoE "Observer" since 1995), which has been at least threatened with sanctions some years ago..

EU-effects of CoE's Monitoring process became obvious between 2001-2008, since the "closure" of this procedure, when CoE felt that a Country had met most of its Human Rights, Democracy and Rule of Law obligations, (i.e. the "Copenhagen Criteria" for the EU), helped trigger Negotiations with the EU for "Accession" or other closer relations : This occured already before the 2004 and 2007 EU Enlargements to former "Eastern" European Countries, as well as for the commencement of "accession" negotiations with Croatia, and of "open-ended" negotiations with Turkey in 2005.

    But a stricking new development are Holovaty's recent findings that on core Human Rights issues as Torture and Freedom of Expression, Turkey, even "5 Years after" CoE closed its "Monitoring", back in 2004, inciting EU to start accession Negotiations in 2005, still presents grave problems.

    His findings are of crucial importance after a 2008 CoE Resolution called, "if need be", to "seriously consider the possibility of Re-Opening the Monitoring procedure for Turkey" : A move which might affect Ankara's controversial EU bid, since EU Accession Negotiations are based on the Hypothesis that the Candidate fullfils the "Copenhagen Criteria" (See above)..

    Holovaty expressed his will to check  "Matters still Outstanding" and  those that he "didn't have an opportunity to discuss" at an earlier visit this year, "in order to discuss the more complex issues in greater depth", at his forthcoming New Visit to Ankara, before the December 2009 EU Summit.  This is all based on the 2004 CoE Resolution which stresses that, CoE "will continue.. post-monitoring Dialogue with the Turkish authorities,...in addition to a 12-points list,..and on any Other Matter that might arise in connection with Turkey’s Obligations as a CoE member state".

    CoE's Resolution also asks  from Turkey "to secure the proper Implementation of Judgements, particularly in the Cyprus v. Turkey InterState case", of 2001, which concerns also the plight of many Hundreds of MISSING People. It adds Turkey's obligations to "execute" ECHR's Judgements in the Loizidou case,..and in particular adopt General Measures to avoid repetition or continuation of Violations found by the Court" to the detriment of Refugees.

    Nevertheless, Holovaty said to "EuroFora" that "MISSING" persons,"might be included" and cannot be excluded, but he has yet to examine the situation "to find out  which issues will be raised" to the Turkish Government.

    Therefore, "EuroFora" asked Halonen, as the Historic "Mother" of CoE's Monitoring mecanism, if she thought that, "whenever there are grave Human Rights Violations, as fex. "MISSING" persons, attested even by ECHR's judgements, they should be always checked by a Monitoring process. Or could they be forgotten ?"
    
     - "We (CoE) must be, at the same time, Fair, Realistic, but not in the mind that "now we have Forgotten", etc., replied to "EuroFora"'s question Halonen, speaking as a matter of general principle.

    - "When we think of those People that are suffering from the lack of Democracy, of Human Rights, and of the Rule of Law", "we should find a base on how to deal with the (Monitoring) system more rapidly"', she stressed.

    - "Sometimes it's very difficult to combine Transparency and Effectivenes together, particularly in this specific case", she went on to say. But, "I have not found a (CoE Member) Country who could be insensitive in this sens", Halonen answered concerning grave Human Rights violations attested by the ECHR.

    - "I have no ready-made answer. I have the expectations that you, in the CoE, will, step by step, find the different types of the monitoring systems."

    Also "because this is a part of the UN's Post-Conflict system, (fex. when it comes to Cyprus' MISSING persons), and it's a more Global system". So that, "If we make a succes in Europe, the others will follow", throughout the World.  "But they expect that we (Europe) are this opportunity, this Opportunity to make a Succes", Halonen concluded.

    In addition, she advised to extend CoE's Monitoring to all its 47 Member States, "because, as long as we hear that, all these monitoring systems are "OK for the neighbor, but not for me", "it's very difficult" to understand. Something which could make easier to Compare...

    Finnish MEP Jaako Laakso, former CoE Rapporteur on the Occupied Territories of Cyprus and one of the 5 Signatories of the Historic CoE's call to create the "MONITORING" mecanism since 1996, was more specific :  - "We (CoE Assembly) have to find a way for the issue of Cyprus' MISSING People to be better followed", he stressed, anouncing his intention to "speak to Mr. Holovaty" about that. "There might be also other ways", added Laakso.

    - The 2008 "Year had been a very Bad one for Turkey with regard to Human Rights in general, and Freedom of Expression in particular", denounced, meanwhile, Holovaty's preliminary Post-Monitoringh Draft Report by Holovaty, published by the CoE on April 2009.

    "Amnesty International believes that freedom of expression is not guaranteed given the various articles of the Criminal Code that restrict it. .. "For example, 1,300 Websites are said to have been closed down by the (Turkish) authorities in 2008" ! While "the new Turkish Criminal Code was used to bring a total of 1,072 proceedings between June 2005 and April 2008, and led to the conviction of 192 people", for expressing views. "Representatives of the Özgür Gündem newspaper, which specialises in Kurdish affairs, ..complained about Numerous Attacks on their Freedom of Expression ...as was everyone who advocated a settlement to the question by means other than the intervention of the army" "According to their figures, 19 Newspapers had been suspended 43 times between 4 August 2006 and 4 November 2008" !...

    Moreover, on 2008,  CoE's "Ministers adopted its 4rth Resolution on the execution of the judgments of the ECHR, ...and outstanding issues regarding 175 Judgements and decisions relating to Turkey delivered between 1996 and 2008...  concerning Deaths resulting from the excessive use of force by members of the Security forces, the failure to protect the right to life, the DIisappearance and/or death of individuals, Ill-Treatment and the Destruction of property". CoE's " Ministers urged the Turkish authorities ...to ensure that members of Security forces of all ranks can be prosecuted without administrative
authorisation" for "serious crimes". Holovaty reminded.

"Nonetheless", Holovaty heard anew of "Several cases of Violence committed last year (2008) by the (Turkish) security forces". Amnesty International speaks of Many Cases of ill-treatment and Torture in the prisons and by the police". "Including, fex."'the death of Engin Ceber, a young man of 29 who died on October 2008 as a result of the TORTURE allegedly inflicted on him by police officers, prison staff and members of the gendarmerie. He was part of a group of people arrested on September 2008 during a demonstration and Press Conference in Istanbul'. Proceedings against suspects are "on-going" in this case.

- " I therefore noted an Obvious Contradiction between the Government’s stated “zero tolerance” policy.... of Torture and other forms of ill-treatment, and the different testimonies given", denounced CoE's Rapporteur.  Turkish "authorities must make considerable efforts to guarantee that proper investigations are carried out into allegations of abuses by members of the security forces and that perpetrators are effectively punished" "In this respect, I have requested detailed Statistics on the number of Investigations, acquittals and convictions in cases involving allegations of abuse in order to show the positive impact of the measures taken to date", Holovaty said, repeating a permanently unsatisfied CoE's demand to Turkey since a Decade...

    - "The Political Crisis that shook the country in the spring of 2008 highlighted the Weaknesses of the (Turkish) Constitution", which comes from the Military regime of 1982, "and the Urgent Need of Reforms", stressed from the outset CoE's Rapporteur in 2009. In particular, "the ...Democratic functioning of state institutions, including the independence of the judicial system, are crucial", he observes.

    But, "the Electoral  system and the ways in which it is circumvented do not appear to give those elected complete Legitimacy, and tend to pervert the course of direct universal suffrage", denounces Holovaty, observing that, even 5 Years later, Turkey did not yet change the 10% nationwide Threshold for a party to take any seat, which is "far higher" than the "3%" maximum in Europe and already condemned as contrary to European Standards by the CoE.

    + Moreover, EU Parliament's 2009 Report on Turkey, drafted by Dutch MEP Ria Oomen-Ruijten and adopted in Strasbourg on March, expresses "Concern over the Failure of the (Turkish) Judiciary to prosecute cases of Torture and Ill-treatment, the Number of which is Growing". EU also "is concerned about continuing Hostility and Violence against Minorities" in Turkey. It also "calls on the Turkish Government to launch, as a matter of Priority, a Political Initiatve favouring a lasting Settlement of the Kurdish issue, (while "condemning violence.. and terrorist groups"). EU "regrets that No progress has been made on establishing full, systematic Civilian suprevisory functions over the (Turkish) Military".

    The final results of Holovaty's 2nd and last visit to Turkley will be known later this year, and, at any case, before EU's December 2009 Summit.
